My father has put the house as mortgage in bank but this house was gifted to me by my grandfather I have a gift deed as per Muslim law hibanama at present I'm fighting a case against my father I HV no money to pay a judge amount to bank and have no other house to go and live with family.. the worst part of this problem is bank people HV come with notice to vacate the house. Is there anyway I can handle the bank and remove the headache of them pestering my family . Pls advice

A.Dear client,
If this what you are stating then , how your father git mortgage your gift dataset to bank, not only that how Bank accepted this document for sanctioning loan. No issue., If bankers are saying to vacate this house then file a writ at HC of ur jurisdiction. Your right must be protected.

A.After gift deed you should have done earlier mutation of property in government records. Now u must have legal recourse challenge to mortgage deed.
