My father has a BDA site in his name (sale deed is in his name). He did not write any will. Recently he passed away. I have 3 sisters(all got married) and 2 brothers. I want to transfer the site in my mother's name (khata). What is the legal procedure to do it? Should i have to get signature from all my brothers and sisters to do it?

A.The property that your father bought will be his self-acquired property. Since your father died without making a Will, the property will devolve according to the Hindu Succession Act and all first-class legal heirs will have an equal undivided share in the property.
The first class heirs of your father will include: his wife (your mother), his sons (3) and his daughters (3). Therefore, each of you have 1/7th share in the property. In order to transfer the entire property in your mother's name, the other legal heirs will have to relinquish their rights in the property.

A.Dear Sir,

On production of death certificate of your father it can be changed in the name of your mother but NOC of all the children is necessary but you may manage BBMP authorities by just giving NOC of you.
