I bought an apartment from SJR primecorp Plazza City in 2013 and as per agreement it was supposed to be handed over in Dec 2016 with the grace period of 6 months. Now its already 2020 and still the apartment is not completed completely and builder is delaying every day by not keeping his promises . I want to take legal action an get the required compensation and loss which I have occurred for the last 4 yrs before I can register my flat.

A.Delay of Possession, you can file a case in NCLT ( National company Law Tribunal) under Financial Creditor. RERA also good option ,if RERA Tribunal in your State.

A.1. serve the builder a legal notice for causing mental and economic harassment by not handling over the possession of the flat on time,
2. also claim damages for the delay,
3. after serving the legal notice file a complaint in consumer forum/RERA

A.If such project registration in RERA then you can file complaint against them immediately

A.If your state has a functioning RERA, please make a complaint before RERA. Otherwise, you can file a case before the consumer court in addition to your normal civil remedy (suit or arbitration based on the terms of the agreement)
