borrowed money returned but cheque not given back

I have borrowed money from a person a sum of Rs 2,10,000 for 5% interset rate per month ,it was transferred in my bank account,as guranatee he took a cheque of 2,60,000,after one year i returned him the money with interest in form of cash,and asked him for cheque for which he told me he is unable to find the cheque right now,its been more than 8 months since then,he has not given me my cheque back, i am worried now what should i do,please guide.

A.Take written affidavit from him immediately with two witness

A.dear client First of all has u obtained any signature from him that he had received some or the whole amount. And have u paid all the money in the presence of any witness and do one thing you stop payment the cheque by giving written application to your bank on the ground that the whole cheque book has been lost and I have signed some cheque. If he has not presented the cheque in the bank you can write an application for missing of cheque or cancellation of cheque stating the cheque number also do you have any documented evidence or any other evidence to say that u have taken money and given him back. If so then you can approach the court. before any further help approach me.

Take an undertaking accordingly. And get issue a legal notice accordingly to return back and issue instructions to the bankers and if you wish you can also lodge police complaint so that you can have multiple defenses if he files a cheque bounce case.
