Question 1.
Can a group of land owners (1-7) provide GPA on the name of a construction company and the company in turn, appoints a GPA (one of its Directors) to execute sale deed in favor of the purchaser?

Question 2.
A Group of land owners (1-7) provided GPA to one of the directors of a construction company, and the said director appoint another Director as GPA or SPA within the company to execute Sale deed in favor of the purchaser?

Question 3.
can a construction company through its GPA executes sales deeds in favor of purchaser of its share of plots ignoring the land owners signatures. here in this case both parties are in development agreement and each parties have their share of plots.,

A.Q.1 - POA can't be given to a Company, but only a director or manager representing the company.

Q.2 - Yes. Land owners can appoint a director as POA and he in-turn can further appoint another person. This is subject to a clause in the original GPA, permitting further delegation.

Q.3 - Once POA is executed, there is no requirement of the signatures of the owners.

A.1) Company is a artificial person i.e. legal entity. Therefore POA in favour of director is valid.
2) Signature of original land owner not required because through POA you have transferred your right in favour of company.
3) You and company is bind according to POA between you and company.

My answers are as follows:

Question 1.

Ans: Yes.

Question 2.
A Group of land owners (1-7) provided GPA to one of the directors of a construction company, and the said director appoint another Director as GPA or SPA within the company to execute Sale deed in favor of the purchaser?
Ans: Yes.

Question 3.
can a construction company through its GPA executes sales deeds in favor of purchaser of its share of plots ignoring the land owners signatures. here in this case both parties are in development agreement and each parties have their share of plots.,
Ans: The share of land owners can be sold by developers if GPA/SPA is given in their favour.
