Sir, on October, 14, 2019 My Aunt (mother's sister) was brutally Murdered by her husband who is a drunkerd, Doesn't work and flirts with women very bad manner. My Aunt who is a mother of three (the younger one is not even a year old) begged him to change his behaviour on many occasions but he didn't. And then on one day when nobody wad home he smashed her face with small cooking cylinder and then with a big wooden pestal and smashed her head to a wall (as told by an eye witness her own daughter who is 6-7 years old). He was arrested the same day but yesterday i saw him roaming in his village. How did this happen. Will he go back to jail or no.. he is a psychopath and we are frightened.. please tell us what to do...

A.Dear Sir,
You may approach the concerned police or public prosecutor who is the State Advocate for complainant. If police fail to file charge sheet within prescribed period then Court will release the accused on bail.

167 of Cr.P.C - Procedure when investigation cannot be completed in twenty four hours.
(a) 1 the Magistrate may authorise the detention of the accused person, otherwise than in the custody of the police, beyond the period of fifteen days; if he is satisfied that adequate grounds exist for doing so, but no Magistrate shall authorise the detention of the accused person in custody under this paragraph for a total period exceeding,-
(i) ninety days, where the investigation relates to an offence punishable with death, imprisonment for life or imprisonment for a term of not less than ten years;

(ii) sixty days, where the investigation relates to any other offence, and, on the expiry of the said period of ninety days, or sixty days, as the case may be, the accused person shall be released on bail if he is prepared to and does furnish bail, and every person released on bail under this sub- section shall be deemed to be so released under the provisions of Chapter XXXIII for the purposes of that Chapter;]

A.You can try to do enquiry in court and concerned Police Station and make enquiry regarding his bail order.Then you can file application before Sessions court for cancellation of his bail due to his bad reputation and behaviour against you.And due to heinous crime.

A.Firstly fir should be registered in local police against him.???Post mortem of dead body may be best evidence against him for his arrest.
