We purchased equipment(3D Printer cost of 4200000) from Germany with Indian Distributor paying them 100% Advance and we received material but every 15 days equipment breakdown through some issues. Local engineer they are not able to solve and finally from germany the technician has come and dint identify the problem or any remedy to that issue. we requested to take back that system and refund tha amount or replace the new machine. they are dragging and trying to solve with this euipment only. finally,, we want to proceed legally.
My doubt is we need to go to a consumer court or the other. we are using the printer for commercial dental lab. can anyone suggest pls

A.as per the act and my understanding of various decisions in this regard by the apex Court, you fall under the category of CONSUMER and can file a consumer complaint against them,
take more proper advice by sharing relevant documents before taking any legal action,
however, a legal notice should send without any further delay,

A.Dear Client,
To some extent your doubt is obvious, bcz, you have purchased such equipment for your commercial lab, hence you are not considered as consumer under consumer Act. However, if this is only one lab using as commercially , which is the basis of your livelihood and bread and butter for your family then you are consumer.Hence you may go to fight for deficiency of purpose and functions and defective supply of equipment.
Thanks

A.If equipment is used for commercial purpose you are not consumer in strict sense. However if the activity involved your daily earning and survival thereby it does. Thanks n regards
