I want to file a defamation case against people who spread wrong things against me. Whether I should file a criminal case or a civil case? Or should I first file a criminal case and after that a civil case one after other?

What I the right way to proceed in this matter?

A.You can file both Civil and Criminal cases but in civil cases, you have to deposit Court fee subject to your claim.

A.You can file criminal case as well as civil case against those people, you have the right to file both the cases. In criminal case, you can file a case under IPC for criminal defamation under which they can face 2 years imprisonment with fine. In Civil case, you can simply go for the damages which you are facing due the defamation. Best of Luck!!!

A.Dear Sir,
1) Defamation cases are of two types, criminal and civil.
2) In Civil defamation, a mala fide intention to defame is not always necessary. If defamation is caused, thenbsuit lies. Court fees are required to be paid as per value of damages caused to reputation.
3) Criminal defamation must, in addition, contain some deliberate malice or malafide intention, to cause damage to reputation of someone.
Here, court fees are NOT required at The level of a civil case.
At the end of case, court punishes offender if defamation is proved.
3) In civil defamation case, at end of case, court awards damages to compensate loss to reputation if defamation is proved.
