Refund of money

I have booked a plot of 300 Sq Yrds with a renowned Real estate company to be paid in installments. and accordingly I have paid a lump some of Rs 349000/. But after paying Rs. 349000 I could not afford that installment due to some medical expenditure. So I spoken to the Marketing officer of that company expressing my inability to continue the installment and requested to refund the money what I paid. Initially he told penalty will be deducted as per the company norms and rest will be refunded. accordingly everything I processed and sent to the registered office. But till today I have not received any amount from the company. Now my Query is: Can I put a complaint in consumer court in such condition. If possible in which jurisdiction I can do? and How to file the case in consumer forum. If any thing you feel better you can suggest. My e-mail ID : [email protected]. Thanking you Santanu Chowdhury
You have to get issue a legal notice and then file a consumer case.

you can file a consumer complaint against them for claiming your amount from them along with the relevant interest,
if you had made the request for return the amount in a written format?
start by sending a legal notice through counsel
