I'm not married to my partner but have a kid with him, my child is a bit over 3 years. Now, i want to move away from my partner cos i got to know he is already married and has 2 kids. I'm feeling extremely betrayed and want to break up with him and take my child away from Him. Please advise.

You can claim maintenance or permanent maintenance from your partner towards your and your son.

A.Hi client,
You have the full right of getting the custody of your minor child. Moreover you can file a case against him, asking for maintenance.

Please take a note that you can live separately and cannot blame him since you did not marry him or he did not marry you. You both agreed and lived. So you can go away from him.

A.You can move out of the relationship.
1.as a biological father, he has some rights and responsibilities towards your child.
2.as your child is minor so you will be getting the physical custody.
3.if you earn well enough then there will be no problem in future also to keep the custody.
4. A child born out of a live-in relationship is allowed to succeed in the inheritance of the property of the parents (if any) and subsequently be given legitimacy in the eyes of the law. and so you can ask for maintenance for your child.
5. you can also go for joint custody if you want where the father can meet the child for a certain day or days in a month or year under observation and mother will be having full physical custody of the child and economic responsibilities can be divided.
6. But if you want you can go for single custody, you are entitled.

A.Make an application to the concerned Local Court. Very probability owning ur favour as child only three years.

A.Yes you can take away your child. As you were not married to him so he won't be able to claim the custody of your child.

A.1. you can move out of the relationship, who stops you?
2. if your partner is making any trouble you can file a criminal complaint against him,
3. you are also eligible to claim maintennace, if you want,
4. you are entitled for the child custody
