Friends pl comment on this issue. There is one live example of psu where officer resignation wags rejected in writing after issuing chargesheet on filmsy grounds.
Officer finally on appeal able to get set aside his orders of compulsory retirement and got orders of reinstated back in to services.accordingly he joined duties again
But he was relived immediately on the date of joining saying that your resignation is accepted.
So my question is that his relieving is totally illegal as he was restored back in to his original position and he has not submitted any fresh resignation after joining duties on reinstatement.
According to my knowledge His all resignation etc became null and void on getting reinstated back in to services .
So actionof employer is totally illegal and officer has the right to join services again with all notional promotions as well al consequential benefits from.the date of illegal reliveing .
Pl comment on my views.
If any relevant judgement pl provide.
