Ever since we got our part of land my father paid its tax and we have been cultivating for 20 years. But my father's brother converted it to his name without my father's concern. We have no debt to him or his family. My father recently came to know that he converted it to his name 3 years ago. When my father went to apply for the pass book for the land the concerned officer asked us to wait for some time. Its been three years and now the officers it is your brother's land. Since three years he is taking the money that government sanctions for the owners of the land.Now, what should we do? How do we get our land back?

A.this land belongs to your father and if in revenue record your father's name was there and for last three years only there is change is that name in revenue record it does not mean that ownership of land has been transferred. because name in revenue record ( mutation ) is not proof of ownership . You can apply in the office of concerned Tehsildar for correction in record and if he does not respond you have right to go to concerned SDM sub divisional magistrate office too. in case the land has been acquired for any government project you can file and move application to become necessary party into it and you can file a claim of your part .
