How much maintenance amount to be paid for 1 year married life to my divorced wife and new born baby out of my salary Rs.8000.00

A.Hi client,
It completely depends upon the status of your wife. If she has a job or is able to manage herself and the child, then you shall not have to pay much maintenance. It is completely upon the discretion of the court. If your wife is unable to maintain herself then you need to pay accordingly .

A.Sir,

There is no formula for calculating amount of maintenance in a divorce case. However, courts keep into consideration various factors in mind while determining the amount of maintenance such as wife's separate source of income, standard of living of both the parties before separation, expenses required to maintain children, skills, capabilities and educational background of the spouse to earn his/her living and maintain themselves etc. Your income is not the sole criteria for such determination. It might very well exceed your monthly income. The Court can also grant temporary maintenance to the wife during the pendency of the maintenance petition.

Generally, court decides such amount of Alimony , there is no fixed rules for Alimony amount it varies. In ur case may be 4000/-

A.Hello Client,

That would be depending upon how much your wife prayed for in her Maintenance Petition or in alimony.
and then the court will pass an order accordingly after listening to both the parties you and your wife.

So you have to show and prove that you can only pay a certain amount with sufficient reason before the court.

A.Maximum 25% is what is fixed.
However, this is the upper limit and in very rare cases it extends up to 25%.
The Court will take into consideration your salary and other relevant factors and then decide upon the quantum of maintenance.
Property and other sources of income also count as income and financial soundness. Hence, court will not be swayed just by the fact that your earn Rs. 8,000/- only.
