My grandma died on 2015. She had 2 daughter and 2 son. Daughters are alive. Both Daughters got married before 1979. Do those daughters have equal rights on the ancestral property and my grand ma property. I am a son of one of the daughter. Please tell me do can we claim a share.
A.Dear Sir,
The law on women’s property is as follows:
HINDU WOMENS PROPERTY…. HOW IT DEVOLVELS
A hindu woman holds the property as an absolute owner and now she can dispose off the property as her own property. The concept of ancestral property does not apply to a property held by a hindu woman. Your maternal grandmother (naani) can will the property to anyone. However, if she dies intestate (without a will) then the property will devolve as per the rules of succession in Hindu Succession Act, specifically, section 15. In that case, the property goes to the legal heirs of the woman on her father’s side if she received the property from her father’s side and to her husband’s side if she received the property from her husband side.

A.First error of Law you are having is that you are referring to grandmother`s property as a kind of ancestral property in which her daughters for having married before 1979 are in your view excluded. Your grand mother`s property is women`s absolute property and will be subject to Hindu Succession Act.
