I want divorce from my wife, can it be possible to waive off mandatory 6 month cooling period & get it asap, also she is in nagpur, so which state is preferable in terms of quickest divorce, also my w

Posted 7 months ago

A. she is in nagpur but in which state are you ?
mutual divorce only have 6 months cooling off period which does not have any compensation.
so for compensation in mutual divorce, it depends on both of you.

we had done divorces without going to court (online) and even in less than 3 weeks but it depends case to case.

My brother got anticipatory bail after signing MOU with his wife in session court for FIR 498A there is no chargesheet filed she has given certain cash amt without anything in writing as per lawyer's

Posted 8 months ago

A. First of all, You have to understand legal procedure. Even if your brother has signed MOU with his wife and ready to settle down all matters you all have to go through with all legal proceeding. without chargesheet this 498-A criminal proceeding will not be closed. So let concerned police officer file Chargsheet then your case disposed off as early as possible if courts and witness support in this case. You cannot skip this legal procedure in order to close this matter.

Is there any exemption for Senior Citizens for 498A case. If so what is the procedure ?

Posted 8 months ago

A. no exception.
but if son and daughter in law never visited your house or you not went to their house then no domestic violence.

in most of cases, parents names are dropped by police in chargesheet.

Hi Sir/madam, I wanted to know which one among the 3 cases (498A, 420 or 406) are big/dangerous cases filed against men.

Posted 8 months ago

A. According to the law, if you have made a mistake and your wife proves it then you will surely get punishment but if you are innocent then you need not fear whether section 498A, 420 or 406 will not spoil you.

A. The caste of a person is determined by his birth. If you are changing your caste due to any greed or to get married then this is wrong by law.
