Case settled in lokadalat 2 months back. Want to apply for decree. Do I have to sign to get decree copy. I don't want my lawyer anymore. Theaccused did not pay the amount by today, which is due date today. Can I file execution petition immediately.

A. Yes you can file an execution application in concern court for compliance of the order of lok adalat. You have a need of certified copy of the judgment.

Inspite of Calcutta High Court Order to dispose of my appeal against dismissal of service within 15 days of communication of order, Appellate Authority of United Bank of India has failed to dispose of my appeal even after 2 months because UBI don't have any authenticated evidences in support of charges mentioned in chargesheet. 3 reminders have already been send to them. Now I want to file contempt petition against Appellate Authority of United Bank of India with appeal to Honourable Justice to quash my dismissal order and reinstate me into my regular service with protection of my seniority level and promotion as per my batchmates including payment of full salary for this period. Can I do this? Plz guide me in this regarding.

i booked(not registry) a flat in 2016 in noida at that time i am unmarried. now last year i am married i want to add my wife as coapplicant. but builders says right now it is not possible because all documnet gone to the authority to registery. is there any process to add coapplicant to my booked flast before registry. i want subsidy under PMAY.

A. Before registry of your property in concerned sub registrar office or GDA, you may add the name of your wife as co-applicant. Your statement shows that your builder does not want to take your headache, you may file a written application before your builder and copy to GDA or concerned sub registrar office. Your builder can not denied it.

A. Please ensure that without your written consent, your brother can not take the finance on your bike and financer can not approve the said loan to your brother. If it is happened so, it is an offence of criminal fraud and you can lodge an FIR against the financier and your brother on concern police station.

There is a website dealing in women clothing, they are cheating customers with their money. They are not delivering actual product but some cheap stuff. They are openly doing marketing on Facebook, if a customer tries to message them , there is no response. Their contact number is also wrong. What action should be taken to stop them . Can we complain in cyber crime cell for online fraud?

A. Yes, it is a clear case of cyber crime. You can complaint to cyber crime police immediately and do not delay to lodge an FIR against those fraud women.

Hello Sir, My sister got married in July,2013 at our home town (Jalpaiguri, West Bengal), but shifted to Delhi with her husband in September,2013 as he was employed there in a private firm, though her husband's home town is in West Bengal too (a place known as Malda). Six months after her marriage, she was being mentally and physically tortured by her husband and her in-laws (who frequently visited Delhi) for dowry and a motorcycle. My sister kept on tolerating all these and was scared of telling us about it. She had a hope that everything will fall in place with due course of time. But the torture kept on getting more violent and she was kept in house arrest for months. One fine day in the month of December,2015 she was threatened by her husband of not entering their house or else he would kill her. That very night my sister slept in her land lady's house and the next morning she somehow managed to reach the local police station, and had called me too (as I stay in Delhi too). We filed a written complaint against her husband and the copy was received by the police station. The policemen in the police station initially tried to sort the matter at their end by calling her husband over but nothing worked out as he was a stubborn idiot. Hence the police asked us to visit the nearby CAW cell, which we did on the same day and submitted a detailed complaint about the entire scene since her marriage in 2013. Three counselling dates were given and we were present in all the three days (the opponent had come over too), but none of the counseling worked and hence we were told by the case in charge to settle it outside by filing a case. Since that day in December, 2015 my sister had moved back to my hometown (Jalpaiguri, West Bengal) and she is in a mental trauma. We did not take any action against her husband or his famity till now as we were more concerned about my sister's well being. However, after a span of almost 2 years her husband and his family had sent a letter at our hometown address, through a lawyer about seeking divorce. We received the letter. The lawyer whom they had sought help from, had called myou mother over the phone and discussed about it, to which my mother had said that if thet pay us 15 lakhs (5 lakh for marriage expenses + 10 lakhs for my sisters maintenance ), we will be more than happy to give divorce. We never heard back from them anymore. But, on 23/08/2018 a letter was sent from New Delhi Saket Court at our hometown address which my mother couldn't receive it as she had a broken arm and no one was present at home. We do not know what was that letter all about. We are extremely mentally disturbed with all thsee. All I want to know is, can we file 498a from our home town against her husband and his family. I would be highly thankful to you if you can advise accordingly. Your kindness will be highly appreciated

A. You sister can file a criminal complaint or FIR 0f 498-A IPC, and maintenance case under sec 125 Criminal procedure code,1973 before the concerned Court of Jalpaiguri, West Bengal against her husband. Another a case of Domestic violence can file against her husband and his family member before the concerned Court of Jalapiguri. Your sister can move a writ petition before the Delhi High court for transfer of divorce case from Saket Court Delhi to Jalaiguri. Once the case will be transferred, your sister may file an application of sec 24 of HMA for grant of another monthly maintenance.

Dear sir,i have filled RCR ,section 9 under HMA to get back join with my family to my wife. The judge allowed for reconcilation for 3times,but the respondent was absent. What should be the next step from the point of judge. Looks like wantedly my wife dont want to attend for Recincilation.and she dont want to show my 2yrs daughter also. How ever,from long six months iam attending courts.And it may take near about 1yr to get final judgement in my favour. 1) I thought that they are creating false proofs to make my character bad. if they put any harrasment type of cases,as i already filled RCR in court,is their false case will make strong? and her father is one of senior advocate in the same court. 2) If even my wife not followed the judgement,what should be process if she no attended reconcilation ? how long it will take ? 3) In the meanwhile , can i request to court to see my daughter like frequent once in a week at court ?

A. If you're wife has not attended the reconciliation proceedings, it means that she do not want to join your family and court may proceed to the case for further hearing. In the meantime, you can request to court for a meeting with your daughter

We took loan for building our house and we couldn't pay the complete loan in time so bank gave us notice we were in lots of tension so my father decided to take help of one of the wealthy person in our town . He saw our situation but instead of helping us he took advantage of our poor situation by buying our house in less amount than we asked . He betrayed us. And now we want our house back not in the price he asks but in the price he took from us . Is it possible if yes the please do tell us the procedure for it.

My mother in law gifted her house to my wife. But her small brother and his wife entered forcely.bitting my wife and my mother in law. Police said file court case. What we do criminal case file or property stay take plz advice me.can her brother forcely entered her house.

A. You can file a criminal complaint against your brother in law and his wife under section 190 and 200 Criminal procedure code before appropriate court. Another a permanent induction suit file against them for prohibition of their entrance in to your gifted house

requiring advice on how to sell a house owned by my expired mother-in-law. My husband died, my father-in-law died and i have one unmarried son and a married daughter. My husband is the only child for my expired parentinlaws. We are the only legal heirs for owner of property (my expired motherinlaw died before twelve years..should i go to court to get succession certificate as property owner death year is twelve years back or can i get legal heir certificate from tahsildar within two months)..i cannot afford to pay lakhs of rupees to get succession certificate from court..Please suggest me how to sell the property of my motherinlaw soon and the needed xerox to get any other required certificates to sell the property of my expired motherinlaw. Thanks.
