Hello sir, Greetings of the day  My question is when the Police had not done the investigation properly on the top the evidence like CCTV footage, original bus ticket, statement of Witness he gave in written against via Email to Police( as the witness leaves in a different place ) the accused was not brought before the trial of accused. I have been the complainant have informed the court before my examination. I have filed the protest petition but the learned judge is asking us to provide the Judgment if has any that when the FIR is registered under 154 crpc, whether the complainant can file protest petition. I was not informed by Police at the time of filing charge sheet and trial of accused was also conducted . we have produced the judge of Karnataka and Madras HC, but as this case is of Maharashtra. Judge is asking us to provide any such judgment. I request you if you can help me with this. 

A. Hello Madam,
You should file an application under section 91 of Cr. P. C. Seeking CCTV footage. If the accused is not appearing before the court, u should protest,in writing, his application for exemption from appearance.

My husband filed a divorce case 8 yrs ago and it's still proceeding. We never got sanctioned for my daughters maintenance. My husband doesn't even look after my daughter. We filed a domestic violence to live in the house with him. But we failed. Nw I am planning to divorce him. But I need something for my kid. So I have asked to give me back my ornaments and to transfer his property to his daughter. He is not Willing to do both. Our courts destination changed and it's been 9 yrs. Are we getting fooled? Or wat can we do to achieve our goal. Is it necessary that I should not divorce him to achieve my goal? Regards.

A. what was the status of other cases/claims?
are u working?
on what grounds the Court dismisses the DV residence order?

I want to stay with my husband, but he is telling me know, I can't stay without him Even though I have not done anything wrong What to do

A. A. Dear client , if you are really want to stay with your husband then File Restitution of conjugal rights petition before Family court and try to get mediation by mediator judge. If your husband refused to cohabit with you , then you need to file Application under Protection of Womens from Domestic violence Act, 2005 and get protection and residence order in same house where you were lastly resided as husband and wife. But keep in mind that Filing of Domestic Voilence case would be the last option after your all the try's of amicable settlement.

My sister is 29 years old. A 39 year old married man has convinced her to marry him. He has a 8 year old son. He says that he will divorce his wife, but his wife does not want to divorce him, neither she wants to file a case in the name of family reputation. Mh sister and that guy are working in australia, currently they are in India and about to leave on 6 Jan. we have tried explaining to both about the negatives, but they are not listening. The guy has convinced my sister to an extent that she says that she will suicide. Can we file a complaint against the guy? and what grounds should we file a complaint

A. Dear Client,
First you decide what to do.
Then get in to action.
cases can be filed in Australia under Australian Law even if he has taken Australian Citizenship.
If he is a NRI this can also be taken up as per the norms and guidelines of Government of India.
But either your sister or his first wife has to come farward.
This much for the time being.

My friend Lokendra got married in January, 2015. The couple shares a bitter relationship with the bride- Raj Kumari, always threatening to file a dowry and assault case. Ultimately she has registered an FIR alleging the same. According to plea, Lokendra's family had gone to Sabalgarh(MP) on 8th July, 2018 and abused Raj Kumari and her family both physically and verbally. She has named her husband (Lokendra), father in law (S K ), mother in law (Rajni ) and one of the brothers in law (Swapnil ) (since he has a government job). The family is seeking anticipatory bail. Unfortunately there are not many evidences to prove what a person was doing on a Sunday (how do you prove one was sleeping at his house). The family had filed the first petition for bail for S K and Swapnil. It was rejected in the lower court. Ultimately the high court granted bail to SK since he attended a meeting on the said date and produced papers of the same. However, Swapnil stayed at home on Sunday and has no such proof and his bail petition was rejected. Kindly guide what to do now. We've little time considering constraints if govt jobs

A. It is advisable to take a paid consultation from any Vidhikarya Lawyer. Bail is not a matter of right but depends on the discretion of the court. In your case, it will depend on the facts and circumstances for that you need to bring all the relevant documents you have.

Sir ladayi huyi thi 2 parties me . Us ladayi me done parties ke people injured huye the.. police ne hamari f.i.r me hospital ke c.r number bi likhe the jo admit the.. but hamare ik bande to jada injurey huyi thi. Doctrs ne head opration kiya tha . Aur aj vi wo walk nahi kr skta. Doctrs 61? disiable certificate diya hai... But police ne dusri party se mil kr ..dusri party ki help ki... Dusri party ne f.i.r nahi karvayi.. aur police ne i.p.c 307 nahi i.p.c 308 laga dii.... Sir m puchna chah ta hu ke jab dono parties ke people injured ho.. aur dono parties ke people hospital admit ho .. fir police ne i.p.c 308 kaise laga dhi...please mujhe bata do m kya karu aab

A. Is baare me written request apne area ke SP ko dijiye. Agar Koi karyawahi nahi ho to charge frame hone ke pahle uspar apne lawyer se argue karne ko boliye.....
