A Boy Name "JAI " 12 Years old Yesterday on 21/03/2019 met with an Accident , car ran over the foot of the boy, the Person driving the car just said sorry and went . Boy was taken to municipal hospital Doctor advice for immediate X- Ray after the reports it was diagnosed fracture in his right foot , Also the wounds were bleeding on the elbow, hips and foot toes . Hence He was plastered on Right Leg. Also at the Same instance Child started Complaining about his feeling of Giddiness Vomiting and headache Doctor advised C T scan of head immediately, CT Scan was also done and the reports showed there are no major problems, but Medication are needed . As Doctor gave an option of taking him home but taking good care or Hospitalization. We discharged from hospital at night , now we want to lodge a police complain and file a Case Against for the accident and loss happened.

V four brother living in a joint house named on my deceased mother. The property is undivided. The 4th brother family is living on ground floor. The 3rd brother family and my family is living on first floor, sharing toilets and one room i hv, while 2 rooms r with 3rd family. The 30 gaj is free area with jaal on first floor under control of 3rd family. The 1st brother family is living on top floor with attached bathroom n one room n kitchen.30 gaj area is free on top. 30 gaj area is open n free , not built above the jaal. As i hv smallest area, can i go for partition suit? How court will divide area for me? Will court give me one third area or one fourth area on each floor.plz guide...

Hello I have recently posted an ad of my vehicle on online selling platform and one interested customer approached me and asked for vehicle Documents and my ID proof to cross reference. He is now not responding. Can he do anything with pic of Insurance and RTO and my adhaar?

A. First of all try to escalate and try to resolve the issue personally. Next you can get a lawyer to file a legal notice. Thereafter, file a suit for recovery with interest.

Sir my husband filed divorce case saying that i try to commit suicide by eating pills ,I run away, ifight with him,and after that counseling started his dad is a lawyer he has influenced the counselor in court.ihv filed 498a in police station but police is not moving my charge sheet ,police is again forcing me to settle behind court either in terms of mutual divorce or restoring marriage.i hv met many times but still they r not listening,mean while my husband has filed custody papers in court ,I hv a small daughter a out to be 5,in reply of section 13 which my husband has put on me .I hv mentioned fir .to that he replied that I want 50 la. Rupees and his house so I hv filed fir.what to do I my really tired.how to bring them under pressure.is there justice in court or they will also behave like police.plz help me.

A. As per Hindu Marriage Act, 1956, you and your daughter are entitled to maintenance and alimony till the divorce petition is pending in the family court, if you are not having any means to earn. You can also file another petition for maintenance for your daughter and yourself under section 125 of Code of Criminal Procedure. The custody of your daughter will be given to you only as she is just 5 years old and a female. If you think that your marriage is not going to last for long and there is an irretrievable breakdown in your marriage then it is better to go for Divorce by mutual consent and take permanent alimony and monthly maintenance from your husband for maintenance of same lifestyle of your daughter and yourself as it is before the divorce plus a suitable place for living. In my opinion, kindly meet and engage a lawyer who shall help you out in the entire matter.

Respected Sir/ma'am, I've got married in Arya Samaj Temple Raipur on 21/012019. My wife told me to rescue her from her maternal. I picked her from there but her family called her and told her to come back to home otherwise they will do suicide. When i send her with her Elder brother by requesting him for arranging remarriage of us. He told me, will do discuss at home. But when she reached her home her family forced her to not to live with me otherwise they will commit suicide all the members of hEr family. Yesterday we were met for the discussion but she asked me for divorce also she realizes her feelings and told me that what is in her heart about me. She also behaved me as she wants to live with me but she says to having divorce. She is forced and going to do so what she never thought about. I love her and want to live with her whole life but what i do I'm depressed. I never thought of having separation and she too but she is forced imotionally and mentally resulting she refusing to live together . How I save my married life? How let I get off her from all the pressure what her family Environmented on her. Please help me and provide me the best effective advice. Thank you!

A. You can file a petition for Restitution of Conjugal Rights under section 9 of the Hindu Marriage Act, 1956.

I have edited my divorce petition and submitted it along with affidavit in the court on the ground of cruelty... Also, I have drafted the decree and submitted it to the court as requested... In my divorce Case, sec 24 is rejected to wife and evidence and issues framing is pending... 1. Please let me know what will be the next steps in my case? 2. For a man, is he have to do affidavit for each page every time??? Please let me know... Thanks

Hi have been married last 1 year, after marriage my wife attitude has been changed she never take care of my family, every time she shout and hurt herself to show others , she attempt 3 or 4 time wrong things which is really so dangerous. A. Firstly try to sort things out mutually. If things are not changing and are getting out of hand then we can file either for Judicial Separation under section 10 of Hindu Marriage Act, 1956 or straightaway for Divorce under section 13 (1) (ia). Kindly consult a lawyer for the same.

I contributed 50% of building our family property (my parents, myself and 2 brothers) 10 years ago. My parents passed away and for the partition of the property between 3 of us I want my 50% contribution back. Am I legally right to do so?

There is a friend who invested some money in my short films in 2016 and when they did not get distributed I put in my hard work and got them on digital platform in revenue share. Since revenue generation is a slow process so he starts threatening me as in if I don't talk to him on phone I got to return the money immediately. And from last one month roughly am Not talking to him in the night on phone . And in 2013 he said he would invest in a film and wasted my 7 months by sending little amount for writing the script and I used to give that money to the director. Every thing he puts on me money is invested in the short film but he thinks that he lended me that money. I never promised him about being a lover or wife and that is his illusion and he makes stories and says "you have to talk to me. It's a relation of 6 years and I have put in money in your short films.." when I don't talk he threatens me and start typing cheap messages . Earlier out of ignorance I used to talk but too much is too much this year I decided come what may I won't talk. At one digital platform his two short films are running. And two more am trying to sell in one time payment. If that happens I will get him the cheque through a common friend but I won't talk to such sick person. Please guide how to save myself from his threatening and phone calls? And the deal I gave him some other business deal in 2014 he earned money out of it which he would never tell the correct amount and in that deal I earned some 1 lacs rupees so he keeps putting that also on to me as if I owe him that money. And the gifts I gave him as birthday present as a friend I don't count and believe me I never asked him for any money forcibly and he counts his birthday gift of 10k or 22k and shows I owe him even that. When I talk to him on phone in the night he is okay but when I don't he starts typing cheap messages and threatens me as if I have eaten his money and he knows that the money is invested in short films and the short films he saw and the distribution thing I did not know but just to get him the money for two years 2017 and 2018 I did marketing and got his two shorts on digital platform. Please guide me how to save myself from his threatening that he would file a case etc.etc. he keeps saying .... So that I keep talking to him in the night on phone and he believes his illusion that "i would be his wife some day ". Please guide.

You can definitely lodge a complaint with the police and depending on what the contents of the messages are, the police will add Indian Penal Code sections and also sections under Information Technology Act to the FIR. If there is any written contract then the provisions of the contract will have to be honoured by both of you. Rest if more information in detail is provided either through phone or in person then only precise advise can be given.
