My husband has filed divorce under cruelty on me. I have a 10 yrs son. It's been 12 years of marriage. From day one my mother in law and his sister's tortured me for every silly reason. At starting he was good going on he also started not caring every time with his friends office parties etc drinking and coming late if I ask any he used to beat me and say be like servent no need to ask any questions then only be here I said k. In this depression I worked for one year in a office 7 yrs back there I got close with a guy and used to chat through SMS one day my husband caught me and he beat me again and warned me I never talked with that guy but my husband is now blackmailing me he will easily get divorce on showing that SMS 7yrs back on adultery. Is this valid can my past adultery effect my case now he has stayed with me for 7yrs after knowing that . Only SMS record can prove adultery. I am not working can I get maintenance. He is saying u have done ur PG do job I will not give any maintenance. After 13yrs of PG my completion can I get a job I am in search of a job but I am scared how me and my son will live.pls advise me

Your marriage will be governed under The Special Marriage Act,1954.
Documents required for court marriage are as follows:
Documents required for court marriage are as follows:
1. Application form in the prescribed format with the prescribed fees and Application form duly signed by both husband and wife.
2. Passport Size Photographs of Marrying Persons
3. Residential Proof of Marrying Persons/. Address proof of both the husband and wife. Adhaar card was being required for registration too.
4. Date of Birth Proof of Marrying Persons/Documentary evidence of date of birth of parties (Matriculation Certificate / Passport / Birth Certificate). .
5. Residential Proof and PAN Card of Three Witnesses
6. Death certificate or divorce decrees whichever is applicable, in case one of the parties had any marriages in the past.
7. Affidavit by both the parties stating place and date of marriage, date of birth, marital status at the time of marriage and nationality and that the parties are not related to each other within the prohibited degree of relationship as per Hindu Marriage Act or Special Marriage Act as the case may be.
Essential conditions for court Marriage are -
1. There should be not be subsisting valid marriage of either of the parties with any other person.
2. Boy should be above 21 years of age and Girl above 18 years of age.
3. The parties should not be of unsoundness of mind of such a nature as to be unable to valid consent for the marriage, or suffering from mental disorder of such a kind or to such an extent to be unfit for marriage and procreation of children, or has been subject to recent attacks of insanity.
4. Parties should not fall within the degree of prohibited relationship i.e. should not be related to each other.
5. Marriage invitation card, if available.

Hello, my 'Roka has done on the month of May this year but not 'engagement '. Engagement has been planned on december month. But I have realized that this marriage will not be sustained as our mental compatibility doesn't match and called off this marriage in august month. We have not demanded any dowry and we are against that as well. Now girls father threatened us to file the claim. There is no written evidence and 'roka' (shagun) ceremony is a traditional pre marriage ceremony which was held in the presence of family members only. We have not even engaged yet. We have also booked the hall for this engagement ceremony. What about that money? Now girls family are cursing me that I have spoiled the girl's life. I admit that I have done mistake but if a marry now both of our life get ruined and that will be the biggest mistake of my life. Now what I can do to protect myself and my family against these claims? Please reply asap. Thank you

Hi , I got married 2 years before. Now i have a male child of 4 months. From the day of marriage i was mentally abused by my husband. He starting doubting me in all aspects. And he bet me within 4 days of my ceaserean surgery. Now when i checked his mails i came to know that he had many illegal girls contact and was with many prostitutes before marriage and 1 girl has become pregnant because of him. Even after marriage he has messaged those girls and tried for prostitutes too. Knowing all i am not ready to live with him. WILL I GET COMPENSATION IF I FILE DIVORCE CASE FROM MY END WITH THE ABOVE DETAILS HOW TO PROCEED FURTHER

Dear Sir/mam I was married 4 months ago...After a month of marriage i went to my parents home.After 2 days I called my husband to take me to his house. But he said he doesnt want to continue his lyf with me and asked for divorce and also threatens us if anyone comes to his house then he and his mothrr could commit suicide....And he also just informed the police nearby his house that My parents and I would come and create nuisance....So i didnt go to my mother in laws house...i am in my parents house from the past 3 months....will police take action if we go to his house?? As i have right to go to his house will there be any problem if my relatives and i go to his house??

I am a govt.servent ( teacher).IAm married in2005, my husband also govt servent(highschool teacher)& we have 2 doughters of age 11yrs &9 yrs respectively. My husband left us with out intimating me before 1&1/2 month.we covinced him by speaking with his higher officer but he did't come home . He is not willing to what should i do know?

Can I file a case against a boy and his family who fixed marriage with me, they promised me and my family for marriage, the boy dated with me and now they are denying for marriage without any reason. They have cheated me and my family and also the boy's father abused me.

Hi, Im married for last 6 months and we stay in chennai, thoraipakkam. My wife was not interested in mrg and left to abroad without any prior infornation 2 weeks back. A. You can file a divorce case with your temporary address but due to minimum one year time limit (from marriage) you will not be able to divorce now.
