There is a seepage from ceiling on my bathroom caused due to upper floor flat owner not repair his toilet and bathroom. I'm facing this problem since 2004. I had complaint him orally several times and given complaint in written to the society 5 times in last 14 years but neither upper floor flat owner nor society solved my problem. So I have stopped to pay maintenance charges since june 2015. Now society's committee members called me and told to pay maintenance otherwise they will take legal action. They did not giving me reply of any of my written complaint. Please suggest me now what to do ? They charged 21% p.a interest on outstanding amount. I told them I will only pay maintenance after my problem will solved and I will not pay any extra charges like interest, late payment fees, penalty etc. They force me to pay outstanding with interest. What can I do to solve my problem and not to pay any extra money.

A. dear client in your matter you can file a suit against the owner of the flat and the society committee members for harassment and illegal demands along with the main concern of yours i.e seepage.

I am from Punjab and I am a truck owner operating through Truck Union which was registered as a Truck operators Welfare Society last year.The chairman or the president of the society have not given any information on the funds collected and where they have used. Can I file an RTI Application of the same and if so with which department? If Not What action can I take against the society demanding them to show the use of the funds of the society. Thanks!!

A. dear client in your matter Yes, you can file the RTI. As has rightly been said by Mr Nirmal Chopra that, it (RTI) should be filed to the Public Information Officier, Registrar, where such Truck Union has been registered.

I have filed suit for declaration of title and adverse possession, and defendant have counterclaimed to recover the possession. It is says that plea of adverse possession taken as defense only by defendant . Now can I take the advantage of his counter claim to defense as a adverse possession in written statement.

A. dear client in your matter Adverse possession does not give any right over the suit property. It is not clear from your question as to whether you are claiming adverse possession or the defendant. Whoever claims posession by way of adverse possession will ultimately loose the case.

Hi, I have a property in Delhi which I agree to sell last week. Now without signing any agreement as of now, the potential buyer gave me Rs.1 lakh as token money and now demanding the Xerox copies (Marked Crossed) of the property as he wants to make a Bayana. I want to know is it legally right to handover the documents or should I refuse and tell him that until Bayana is signed and we get atleast (10%) of the total sum as insurance, we won't be handing over anything to him ? Please guide me through this process.

A. dear client in your matter Sell of the property through registered sale agreement. Ask the purchaser to to prepare a sale deed and get that registered after payment of agreed amount.

Did not take loan.. Received message stating that summons have issued by court to appear for issuing a cheque for dishonour of payment.... I have not issued a cheque or taken loan for the number sent in message or been a guarantor... No court name, case number or date is given, I called the number it is stating it is invalid number Please advise what to do Thanks.

A. dear client in your case Better to consult a NI specialised lawyer with the summons to take up the case to guide & help you immediately to avoid any hardship & legal issues.

I am living in Australia since 2015. Recently in Nov 2017 I have done court marriage with my boyfriend (in India) so that i can get marriage certificate to apply for his Australian visa. However things do not seems to be working well between us now hence we want to fix the mistake which we have done and get separated so that we can move on in our life. We haven't told this at our home hence please advise if this can be fixed and no one gets to know about this.

A. dear client in your matter best remedy is divorce by mutual consent if you are a Hindu by religion. It will only take 6 months for taking divorce by mutual consent. If you can manage a divorce in Australia do it as divoce is easier there.
