I was intended to sale my house located in Narela. After the initial talks with her (buyer) the sales consideration fixed of Rs. 40,00,000/-. I have shown her all the previous sale documents (original copy of the power of attorneys) of my house. She and her family member visited many times before given advance Token/Bayana and after 1 month of checking or reviewing all aspects, she had paid advance Token/Bayana of Rs. 4,00,000/- through cheque on 31/01/2019 and the balance payment of Rs. 36,00,000/- payable within six-month time i.e. before 31/07/2019 to complete the said deal as per agreement to sell and purchase. On 20/06/2019 I received a ‘legal demand notice to cancel the agreement to sell and purchase and to recover the Bayana amount/part sale consideration amount’ from her advocate. In this notice she made these baseless and false allegations on me: 1. I assured that the abovesaid built up house following the site plan of DDA and falls in an authorised colony. 2. I also assured her that I shall obtain the NOC regarding the sale of said built house from the concerned department. 3. It was initially booked by the DDA 4. I don’t have proper legal sale/title documents in my favour. She lives in Narela with family for the last decade and she had already bought a plot of land in the same Colony before approaching me to purchase my house and Neither me nor property dealer (who lives in the same Colony) told her that the said property is located in an Authorised colony, And her current residence is a 2 minute walk from my residence and She knew that in Narela all the colonies like Sanjay Colony, Rajiv Colony, Indira Colony, Punjabi Colony and Gautam Colony are unauthorised colonies.

I was working with a real estate agent. My employer gave me my salary cheque after I left the job. But cheque bounced. And now employer is refusing to give money. Nd making excuses like I am not in town. I want to file case against cheque bounce of section 138. I need the lawyer consultation.

Dear sir, My wife was give an application to women cell on false dowry case on me & my 6 family members on 3rd march 2019 & counselling date was 12 march 2019. I was apply HMA sec. 9,, on 8 march 2019. On 12 march i said to women cell I want to live her and I love her also she compromise but after same day she goes women cell and requested for take action on me & my family..... Finally women cell & her nearest police station not charged me & my family under 498a. Now I don't want to live with her but HMA 9 was applied by me to save me & family. HMA 9 hearing on 24 jun 2019,,,please guide me how can I deal with her on court so that she will say don't want to live with me(she also don't want to live with me but I can't believe on her because she can be say to live with me to her safe side). I thought I will say to her on court I want to live with u but please bring back all false allegations of dowry from women cell & draft confessional letter to me (i know she will not bring back her false allegations application from women cell) ......This is sufficient or not.. Dear sir please guide me best ways to that will be encourage her that she she will not want to live with me.

I delivered mh kids(twins) last year in gurgaon in Aug since then my MIL hS madd my life hell,,she asked for 2 lacks from my parents and tortured me continuously and my parents even after my parents gave gifts worth 2,.5 lacks she kept provoking my husband against me and my parents,,,she told my husband to quit job and live with her ...We came back she kept torturing me using all her tactics and even my husband started a using me,,hitting me,,,now she has evicted me my husband a d kids from property and provoked my husband to take divorce from me giving them kids M confused to take divorce or not cos I don't want to ruin my kids life ... Please suggest what to ?And if I file a case how can I put my mother in law and husband in jail

A. File a case of DV against the Mother in law and Father in Law and also file a case of 498A against them.
Do not go against your husband as he is just being influenced and is being a scapegoat here.

I am working with a private school reputed one in Dwarka for last nine years. Drawing good salary in salary accounts and form 16 also but not salary slip and appointment letter . Last year I had availed maternity leave for my second child but because of family pressure if I plan for my third child then can my school has legal rights to dismiss my service or not. Basically I want to know that if they do so whether I m legally approach to court or not.

A. The school shall not dismiss your service.
Also there is no specific direction for maternity leave for 3rd child however, you can take leave without payment.
In case you want to take maternity leave you can approach the HC or the service tribunals and get a specific order.
However, you should talk to your parents and re think about the idea of a third kid.

I am currently out of country. I sold my bike in Feb 2018 & purchaser promised to complete the transfer formalities. However, last week I got traffic police memo in my name & address for that sold bike & I came to know that transfer of bike is yet not done. I tried to talk with purchaser but he seem not serious in transfer of ownership to his name. What option do I have now being not available in India.

A. Dear Sir,
Depending upon the offense the action will follows. In most of the cases unless there is a death you can admit the guilt through your advocate in India and pay some fine and close the matter.

Just after 20days of marriage one of my friend wife divorced her husband while the marriage was took place by the first proposal from the bride's side who directly proposed the groom for marriage n even forced her family to arrange marriage with the Boy chosen by her. Now the Boy doesnot want to divorce his wife while the bride's family without any consultation with the groom family suddenly one Day call that their daughter had divorced her husband n they dont want any discussion ahead, what next could be done from the Boy side? Plz advice

A. Instant Divorce is now not applicable in Muslims.
You can approach to the family court and get proper remedy if the bride is not staying with you just after 20 days of the marriage.
Hon'ble Supreme Court has upheld the constitutional validity of RCR or Restitution of Conjugal Rights in the case of all religions including Muslim Personal Law,

A person with a Muslim background has to file a civil suit in civil court for RCR,
The ground for RCR could be that the wife has withdrawn from her marital obligation etc.

However, there is no provision for RCR under Muslim personal law (codified or uncodified).
but as because, Muslim marriage is a contract, u have to file suit for specific performance.

i am sanjay my father had a personal loan from a bank of 50000 rs. he died five years back. i am unemployed and my mother is handicap blind. we have very low anual income. we can hardly sustain our bread. after death of father his land which has low value. transfered to us. from last five years bank was asking from garenter. now he also died. bank has sent notice on my name. saying- come to meet us in bank or we will auction the land. i have questions. 1. can bank auction land transferred to another person, in case i transfer it to some one else? 2. can bank exempt loan amount due to low income and poor family condition after fathers death?

A. As for question 1

Yes the bank can auction the property if the same was given as collateral against the private loan taken by your father who is no more. If the property was not given as security or collateral then the bank has no rights.

As for question 2

Yes. [The bank has the rights to waive off your loan]. However no bank would actually do that so they might allow you to repay the loan amount in very small installments taking into consideration your financial status. OR ELSE, they might settle the whole claim at a certain percentage payment. Say for example settle it at 20% IE. Rs. 10,000/-

My daughter age 39 yrs having 2 sons age: 10 & 3 yrs. is suffering cruelty by her husband alongwith his elder married sister for the last 7 yrs residing near residence. My daughter is debarred from all rights being a wife. My daughter is facing bad condition there. I am 67 years old suffering heart patient. Pl.help me what to do to save the life of my daughter having two children ?

Nothing to worry because all laws are in favour of married woman. Ask your daughter to file DV case seeking following reliefs.

PRAYER
HENCE THE APPLICANT HUMBLY PRAYS
1. to take cognizance for the offence punishable u/s 498A IPC and punish Respondent1 to 3 as per law and extend police protection to the deponent,
2. Pass orders u/s 19, based upon S.17, granting separate residence for herself and her three children at a monthly rent of Rs. 20,000/- and advance of Rs. 5,00,000/-.
3. Pass orders u/s 18, in totality against Respondent1 to 3,
4. Pass orders u/s 20(i) granting Rs.25,000/- per month as maintenance for applicant and maintenance at the rate of Rs. 5,000/- each per month to her three children.
5. Pass orders granting Rs. 5,00,000/- for setting up house hold requirements, in granted residence, to make it livable, as the applicant cannot return to the house of Respondent1 as he is residing in the house of respondent No. 3, which is legally prohibited,
6. Pass orders granting litigation expenses of Rs.1,00,000/- as the applicant made to wander from pillar to post for getting legal aid to attend the Hon’ble Court, whereas, the Respondent1 falsely filed Divorce Petition.
7. The applicant also filed interim application supported by affidavit u/s 23(1) and (2) of D.V.Act,
8. That any other order/s, this Hon’ble Court deems fit, to meet the ends of justice, be passed.
