Hi Sir/Madam, My name is Sriram from Vellore (Tamil Nadu). I got education loan for my engineering degree (2008-12) but could not able to repay entirely. I could not get a job for an year and the job wasn't paying me enough to handle my own expenses. And my mom got cancer and entire money went for that. and I paid 1.25 L and rest am paying month on month (15,000 per month). Am ready to pay 15000 every month but they filed a case against me and asking me to pay 1.5L now but I don't have any jewels or property to sell and pay them. I tried but could not get bulk money. The bank is not accepting my request. If they arrest me, my entire career and life will get spoiled. Kindly provide me suggestions that how can I handle the situation? Thanks in advance, Sriram K

FIR lodge under section 420/406. only against my brother. But in charge sheet police added section 174{A} , 120 (b) and chit fund act. Police apprehended my brother on 10 Oct 2017 and charge sheet filed on 13 Dec 2017 after 60 days and in main charge sheet no any witness mentioned name of his wife and my father. Antricipatary bail of Wife of my bother rejected on 28 feb 2018. She surrendered on 13 march 2018 and my father surrendered on 09 april 2018. Supplementary CS submitted by Police on 10 May 2018 just before completion of 60 days. Accordingly bail of 167(2) rejected. Thereafter 2 bail application application rejected by CMM and ASJ. Now bail application is in pending with high court in which IO submitted that more application is being received hence enquiry is pending therefore opposed bail application. All 03 pers are on Jail since mentioned above. Request intimate what I can do.

Sir my aggriment monthly base and kirayadaar not give 5 month rent and he send me legal notice in notice he say already pay advance 1080000

A. Not maintenable unless tenant shows any documentary evidence of payment.

IN AUGUST 2016 I REQUEST THEM TO RELEASE ME FROM AS DUMMY PARTNER AND THEY REMOVE ME AS PARTNER AND INTRODUCE SUNIL SINGH AS PARTNER. AFTER MODIFICATION PARTNERS ARE 1) SUNIL SINGH 2) KUSUM SINGH AND 3) MANVEER SINGH AND THEY SUBMIT THE MODIFIED DEED AT BANK. IN FEBRUARY 2017 THAT ACCOUNT WAS NPA. IN THIS REGARD PLEASE SUGGEST ME WHAT CAN I DO FOR SAFER SIDE I WILL NOT COME IN TROUBLE DUE TO THIS. PLEASE ADVISE

I am adopted and owner of property.adoption in 1964 .now a will has come of 1945 by my father property to his cousins.my father died in 1970 and after that property in my name today. Kindly give us advice is will in existence or not.

A. If there's a Will it needs to be probated. Obviously you can challenge on various grounds but before that I need to review the documents relating your adoption and the content of the will. Legal positions cannot be answered without complete facts, as the answer will differ from one facts to other facts.

I am only son of my parents my house was in name of my mother now my mother an father passrd away how this property transfer in my name

A. If your parents have died intestate then you need to get their death certificates and obtain legal heirship certificates or Succession Certificate. If your parents have died testate then the executor of the Will must probate the Will. In either situation you have to engage an advocate. Sir, my grandfather acquired property in three names one in the name of my grandmother, one in his self name and one in his last child among three sons , Now both of my grandparents are dead and my father who was one among the three children is also dead, my paternal uncle's ate trying to drive us out of the property which is on the name of my grandfather and grandmother.. Please help me what should I do

A. File a partition suit and get appropriate order.

Sir, I'm having 18-rooms building in pune. It is individually owned. Recently 1-year before maintenance society was formed and it made complaint against me to Pune Muncipal Corporation to charge me as commercial property tax. Till now since last 20-years I've been paying residential tax. In 12-rooms i'm keeping paying guest. Is it correct for the Muncipal Corporation to charge me as Commercial tax ? What I've to do so that corporation does not charge my property as commercial because Paying guest is not an commercial business?

A. Making any sort of earnings or profit from house property either from paying guest or tenants amounts to commercial business and the Corporation is correct in putting your property under commercial cap. What you can do is to appear before the concerned hearing officer on the date of hearing as mentioned in the notice and seek for some relief in the property tax.

I want divorce from my husband. I have two daughter, one is 5 years old and other is 1 year and 2 months old. I got forcely married at the age of 16 and my husband and his family makes false documents in which they showed my age 18 uears but i was 16 years at that time. I suffered lots of harrasment and voilence in that family. I also faces physical harrasment. Now 1 am 23 years old. I loves a guy but i didn't make any physical relation with him. I have a step mother who not loves me ,it is the reason that my parental background is not good. I want a divorce and my little baby who is 1 years and 2 months old. My husband always hurt me physically and making only physical relation. Please advice me how can i take divorce and he is not ready for divorce.

A. You first need to collect evidence that you were a minor at the time of marriage. This is can done by obtaining your birth certificate from Municipality/Corporation which has the actual date of birth. Thereafter file an application of annulling the marriage. As for custody of the child and maintenance, you will get order from the court in your favour. In the meantime you can lodge a complaint with the local police station for domestic violence and 498A IPC and Child Marriage Restraint Act.

I purchase a hp laptop which is metallic body after purchase it give electric shock. When i told them they tell that there is earthing issue with your power circuit. I told them earthing is our choice for safety in abnormal conditions but it is not compulsory but your laptop must work perfectly in normal conditions. But they dont listen to me and reject my DOA complaint for replacement.

A. Give a legal notice for replacement if they don't then file a case before the consumer forum.
