My father took the property of grand father in the document its mention that father buy it from grand father , at that time my father don't have any job my grand father was paralysis also. my father bought this land from grand father on 1987.During 2008 my father took a step to sell the ptoperty at this time fathers both brother , sister have filed a case , for that father had given share to all his brothers and sisters and settle the case. My father had a bank loan that's the reason why he want to sell the land . and he sell the 3/4 th of the land and bought new house. My question is do I have any share in my fathers property or can I file a case against him to stop him from selling the property. At the time of my marriage my father told that this new property belongs to me and he told this to my wife's parents also. I worked in abroad for 4 years and sent all money to my father . now I lost job , now he is saying that he will not give me anything and he will sell the property and I have to go out. Do there is any solution for this legally.

A. As per your personal Law it does not matter from whom your father bought the land, as concept of ancestral property is not there. If you have records of your remittances to him from you when you worked abroad you should claim the amount back from him by filing a recovery suit and ask for an attachment of that house.

My grandfather purchased a site in name of his big son, in that, is there equal share to all siblings sir?

A. If your grandfather is still alive and had no ancestral business or property and the site was bought from any income source of his ancestral property then answer is ' yes'. If your grandfather is now not alive, the other claimants should prove that the site was bought from such a source. that is if the site was bought from your grandfather`s own earnings then answer is 'No'.

A. If your husband survives you and you do not write a will your husband also gets a share in that property. But you have options of gifting the property to a relative, bequeathing the property by way of a will or spending the whole property in your life time.

Me and my wife married in 2014....due to adamant nature, me and she gt seperated on oct 2016. I filed a rcr case in november 2016...and sent lawyer notice and court notice to her rented house. She didnt receive and neither turned up for hearing. I published in newspaper thn also she didnt turn up.....after one year, in november 2017, in bangalore, she filed a protection of women case in mmtc, bangalore.....what should i do now?mine RCR case is towards ex-partee.waht should i do....

A. Your RCR is of no use now, except showing in the DV case that you had not sent her away instead wanted her to be back with you. If you are able to show some evidence that she deliberately avoided summons in RCR you have a better defence in DV case. You have not told what were her allegations in DV case.
