Hello,,i m mr roshan from ahmedabad..i m civil work contracter..3 years ago i complete one project of around 2.5cr on contract base but company does not paying me full amount..now yet around 25lacs is pending..they r not picking up my phones and they dont meet me..i dont have any valid proof of contract..so now what should i do ?? Plz guid me..

A. an oral agreement is enforceable in the court of law. Provided, it fulfills other essentials (of Sec. 10) of the Indian Contract Act, 1872 you have to prove it with sufficient evidence. Send a legal notice by a local advocate from Vidhikarya. If they don't reply or pay the remaining balance, then lodge a complaint with the local police station for breach of contract, breach of trust and cheating. Parallely file a winding up petition before NCLT

They were in a relationship for 3 years and they ended their relationship before 3 months back. He has some private pictures of her and now he is blackmailing her to fulfill his desires. A. An FIR may be lodge against the person who is black mailing you but you will have to share such facts with investigation officer and proof to substantiate your allegations.

I have filed a complaint of sexual harassment at work place against my manager and a complaint against my HRD head for trying to put pressure on me to keep quite about the matter. Later ICC was constituted and I was called to present my case. ICC was biased from the beiging only and gave decision against me stating that my complaint was false and malicious and that I am unwilling to work, incapable and lodged complaint just to avoid work pressure. I am an outstanding officer through out my service of 4 years with excellent track record, I am one among 2% of the officers recently promoted and worked very hard for this organisation. Due to influence of officials on very high post aginst whom I lodged complaint the IC ruled against me. What can I do now? What are my options?

A. By ICC I think you mean the internal Committee that carried out enquiry on your complaint against HRD. Your organisation must follow certain rules of Natural Justice and should have a appeal mechanism. If it does not have still you have a right to either of these: 1. comment on the enquiry report, 2. to appeal against the decision, 3. for a reply to a show cause notice why the case should not be dismissed. Also, if yours is a goverment isntitutiuon, you can approac Court/s.

With the rampant increase in false rape and domestic violence by women's against men in India.Are there some law's which may protect men protect men in case he is innocent.or he will be directly sentenced to custody,even if he is innocent.?

A. No one can stop a person to lodge a complaint under the provisions of the law against anybody. It's the constitutional right that has been conferred to every citizen of our country. However the real test of its genuinity can only be ascertained by the Court of law on the report of the investigating officer and evidences. These laws are not bias and in no way discriminating any particular gender. In fact there are many such incidents reported where helpless women victimised and needs to be protected against the atrocities of men. If a man is innocent, Court is there to protect his rights too. False case fall under the purview of section 182 of IPC.

Corporation, satna has demolished my house, without them having original file as it is under custody of lokaykta since the day of trapping of commissioner kathuria.they have demolished without original file. Under which IPC or any law can I counter corporation

A. your right to remedy lies with the high court. file a writ petition. If such demolition took place without serving a notice of demolition upon you, and you were not given an opportunity of being heard, then you are entitled to get compensation for damages done.

A. dear client arya samaj marriage procedure is legal. for getting divorce you need to file divorce petition before family court. go through local family court lawyer.

Hi It's been 8years we took 80k loan from a person who took 4cheque for that. We paid interest.... It's triple amount than the money we borrowed. But now that person filed a case stating we borrowed 180000. Since he is government employee he s not a legal money lender but he is playing with interest. We payed 80k loan with around 3lakh interest amt for dat till date. Still he is not satisfied. Please suggest. Even we contacted local lawyers but no use. They are asking us to pay and settle.... But this is highly not possible

I brought Samsung memory card from ebay. Com. its not working. when I contact to Samsung service centre they said it's a duplicate card. and I and contact to eBay Customer Service they said they need a written document from the service centre but the service centre is not providing the written document they send only the email when I again contact to eBay Customer Service they said eBay.com was shut down so they can't service anymore. What can I do now.

In the past, I have two voter ID cards in different state(Punjab & Himachal). Last year, I canceled Punjab voter id card. Now a person registers a case against me for this matter (Two Voter id card). What action will the court take against me?

A. Dear Client, If person is Govt. Authority and has issue, related after your cancellation or you simply cancelled it, it would not amount to any punishment for that having two ID of different States, But if you have represented or given these ID for getting any position jobs, or monetary benefits then you may be in trouble, after verification by Authority concerned. How ever this depends on show cause notice if you receive.

My name is karthik. I was married on 2016.after marriage i have affair with another girl (SC cast)who worked as my co staff. We had sexual intercourse many times.she knows that am already married. She forced me to marry her but i refused. The girls parents arranged marriage for both by threatening me. Since that i was absconded The girl was filed case against me & my parents under mentioned sec.420,417,506(2),496 on feb 19th 2018.After that till now am in abscond. My parents was arrested with the same sec and remanded by police.my parents are aged 55&60.I approach advocate to get bail for us. He took bail for my parents with some condition.after condition bail he put relaxation petitions then they relived from condition bail. My advocate tried bail for me two times directly in high Court. But my bail application was rejected by high Court bcs the girl put some petition that me n the girl had sexual intercourse before the marriage. Till now am in abscond. Now police was came to my wife's house for searching me without any warrant.they threaten me to give 50lakhs for settlement.police said they will go to my brother home n took my brother to station for getting me surrender. I need suggestion. They have rights to arrest my brother for getting surrender me. Can i surrrender myself or continues abscond.is there any problem for absconding.help to sort out this issue.

A. Dear client you need to discuss matter with experienced lawyer of criminal court.if there is any possible doubt about your brother's arrest then you can go through lawyer and ask for anticipatory bail.
