I was promoted to Ad-hoc AAO by passing the departmental exam. Head Quarter issued a circular on 02.07.18 by which eligible candidate may appear in SAS Civil Audit exam. I sought clarification from Local Admin (my office) regarding my eligibility but I was not answered that time. Later regular promotion order was issued in favour of me on 10.08.19 and Local Admin. issued a circular on 29.08.18 inviting me to fill up the form for the said exam. Hence I refused to accept the promotion on 29.08.18 as after getting regular promotion candidate was not eligible to appear in the said exam. Later Head Quarter denied me to appear in the exam giving reference to its earlier circular dated 02.07.18. In this situation I was debarred for getting promotion for 1 year and could not also appear in the exam. Had I not been allowed to fill up the form, I would not refuse to accept the promotion. I think department is at fault who invited me without consulting the Head Quarter and I sought clarification also from my office. Pl guide me whether I should knock the door of court to get the promotion from the back date

Fraud Case/FIR was lodged in 376, 315 and 420, NBW was issued, accused is in HC for Anticipatory bail, complainant did medical and gave statements. Now, Complainant ready to take down the case as its already 4-5 months and all are fed up. Please advise what is the fastest/easiest legal way to finish this. This should be done from Police station or Court or both ? Does the complainant needs to give the affidavit in court and police station or both? For expunge, what will be the process ?

A. Dear client,
Withdrawal of case 8s not simply possible, bcz section 376 has been part of FIR, if girl has given consent that what has happened has been with her consent, and Fir has not been lodged by her by any body else. Then case may be dismissed before charge framed.
You may take consultancy onlIne for more in detail discussion and legal advices.
Thanks

I and my husband got separated from two years because of mother in law and now it is come till divorce. They are harassing me for divorce. I tried so much for reconciliation but it did not work. Even I went to Vanitha Sahayavani even there reconciliation failed. There the counsellor suggested to move legally with restitution of conjugal right . Will this work.

A. do you have any kids? do you want to divorce? if they suggest you to file RCR, then I presume, you do not want the divorce, if yes, then go and file RCR, maybe, during court proceedings, you both join matrimonial knot again. Good Luck

A. Cruelty ke grounds pe divorce le aur nahi to rehna band karde. Agar wo case karenge to aap shadi deny kare. Wo prove karenge ki shadi hui thi and agar karte hai to baal vivah aise bhi jurm hai.
Nishchint rahe.

Hi Sir/madam, I am Indian citizen and was in USA. Last year, April 2018, my wife filed a fake domestic violence case against me and took my child to stay in US permanently by taking asylum. I returned to India on May 2018 as my mother was sick and alone in India. I decided not to return to US. Now, I am getting emails from my wife lawyer that I have contempted court in paying certain amount every month and her lawyer sent me NISI to attend the court. However, I am not ready to go to USA again and asked them to send my wife and kid to India to settle case here. But my wife do no agree in it. My question is would that contempt court or NISI order will have any impact on me in India if I dont attend court in US ?

A. No.
As simple as a No.
It shall have no impact.
Thanks
