I am in search of a lawyer who can expedite our case of illegal termination in high court where we have won our case in district court. I am being cheated by a lawyer in Hyderabad who wrongly misleaded by not fighting for our case for the past 10yrs.

A. Dear Client, Get a NOC from ta previous advocate and change your advocate. Though according to the recent Supreme Court judgment , you dont need a NOC to change your lawyer still its better to get one to be on the safer side. Thanks.

I am from West Bengal. I am married. My mother died in 1991. My grandmother died in 2015. I have two maternal uncles. Being only daughter of my mother,whether I can claim the share on my Grandma's Property. Our state is governed under Dayabhaga law. Whether my claim will be valid as my mother died before the Hindu Succession Act'2005 (Amend).

A. Dear Client, Your question isn't very clear. There can be only one marriage certificate. It seems that you have done your marriage according to special marriage act and you have got the certificate but no social marriage has been done between you and your spouse. It is a clear proof and you don't require any other certificate to prove your marriage. Thanks.

Brother,mother & i live in our jointly house. But my brother accupied all place of building covered by placeing meterial like four wheeler almirah like this. My quistion how to protect this type of coverage by legal way.

A. Dear client, The property is supposed to be divided into 3 parts . You and your mother is supposed to get two shares from it. Get a succession certificate and file a partition suit against your brother. Thanks.

I have gone to my nearest police station and talked to the I.S. officer.He said that " this is a family matter we cannot do anything tell your father to do something or tell your mom to write a letter and send to court then we can do something".I don't know what letter what to write please someone help me or suggest me what i can do now.How I can open my mom room that is locked by the step brother. Can't we break the lock and enter in our room as it is our room he or step brother has no right to say anything.

During Summer Vacation in Courts, there is no tasks ? Like no hearings, or appeals or any other process etc ? How we can avoid that delay due to Summer Vacation in Courts ?

A. Former CJI Lodha has recommended that instead of all the judges going on vacation all at one time, individual judges should take their leave at different times through the year, so that the courts are constantly open and there are always benches present to hear cases. And second thing, Courts are not like corporate firms for elite class. Judges face lot of pressure because of pending case. If you still have doubt then look at the data, How much an average judge of high court and other District and session courts dispose cases daily, weekly, monthly and yearly. Its peak time to increase strength of judges instead of questioning their Vacation in equivocal manner. They have to read out each and every case clearly before delivering final judgement, so that right person should get justice. Thanks.

I am confused if I should file a divorce or not. I am 8 months pregnant & since 3 months I am living with my parents, my husband does not bears any of my expenses & neither agrees to pay off the medical expenses. I asked him to give me a definite amount for delivery but he is not giving any amount neither he agrees to give divorce. My family's financial condition is not that strong to bear all the hospital & delivery expenses. What should I do? Is there any resolve to this situation? Can I legally take any sort of action so that my husband takes up to pay hospitals expenses? Kindly suggest. Regards

A. Dear Client, Seeking divorce is a very big decision . If your problem is mostly financial then i would rather suggest you to file a suit for claiming maintenance from your husband under sec 125 crpc for yourself and your child. Thanks.

Can anybody file an FIR against me even though I am innocent and hold me in bail and then later arrest me and if at all I want to bail or if my lawyer asks for bail deny the bail. Is it possible?

A. Dear Client, Yes its possible. In case you commit an offence which is non- bailable, the court considers the entire situation and then may provide bail or may not provide bail if the court thinks its necessary. Thanks.

I was Petitioner in person in my case and said in court that I would like to withdraw my case in court hearing, do I have to file application under order 23 rule of read with 151 or my case is over or is there any other formality which I have to do.

I have been married for two years but in these two years my husband has been abusing me verbally last year around april he slapped me for his neice just because i didn't wanted to give my 5 day old baby in his neice lap.on same night i called my parents and he misbehaved with them too for his brother s family.his brother kicked us out of his house. He constantly misbehaved with me for many days till i asked sorry for it.aftrwards we used to have small feuds but today our daughter got while i was washing clothes on her grandmother's watch. I tried telling him that he got angry and lashed at me and asked to leave the house i told him that he can leave if he wants than after some time he went out and came back and took all the money and his documents and ordered me not to touch them and now he's angry again and says that he won't pay for both of ours medical and other bills and also he is denying to give my parents money back which he took.
