My faced an accident while riding his bike having insurance. But DL on that date was expired & was again renewed later. But matter is that an old woman who suffered from a leg injury has filled a case to claim medical expenses. That woman has recovered from injury and can walk now. But what may be liability for my father and what may be the way to come out of liabilities ?

A. Dear Sir, It will be better if you consult a local Advocate and also with the Insurance Company or Advocate of the Insurance Company.Difficult to tell without knowing the complete case history. Shanti Ranjan Behera Advocate

Dear Sir, Can a Charitable Trust give the land (which it has got on lease from government) to another Charitable Trust as a "gift"?

A. Dear Sir, The answer is NO. But, there is a possibility if there is written something on the Trust DEED and LEASE DEED/Agreement with the Government. But, the chances are remote. Shanti Ranjan Behera Advocate

Now we are facing some problems with that land owners so I wanted to file a suit will it be possible to get back.we can pay the credit amount with interest if even court ask for , I think the amount was less than 20k. We were recruited by DOT , GOI and subsequently on formation of BSNL absorbed there from 2000. The written commitment was that after retirement Govt scheme of pension will be available to us on our combined services in DOT and BSNL. Accordingly after our retirement we are getting our pension as per CCS Pension Rules 1972. Our pension was last revised on 2017 following the pay revision of BSNL employees. But now after 10 years when our pension revision is due from 2017, govt is denying it on the ground that pay revision of BSNL employees this time is not permissible as per affordibility clause of 3rd PRC. As there is no pay revision to BSNL employees there will be no pension revision for pensioners retired from BSNL. We are getting pension from Govt fund and in no way related to profit and loss of BSNL, how our pension revision can be denied. We are now 2 lakhs in number and very soon total such pensioners will be 4 lakhs. Can we file the case in supreme court directly.

A. Dear Sir, Best option for you would be to get in touch with BSNL as they are probably doing something in this regard as they had a nation wide strike. This is a long pending issue and will take time.Actually this between the UNION and BSNL Authorities. This can be sorted out at that level. Shanti Ranjan Behera Advocate

We have been living (Rajasthan) in a house which belongs to a Temple trust. My great grand father lived and since then their descendants (we) have been living, currently my parents are living (I do a job so I live away from my home town). At time of my great grand father, there were more tenants, and few of the rooms belonged to those tenants. Gradually they all moved out, but descendants of those tenants still claim their right on those rooms. As such there is no legal rental agreement or something (basically we do not have any paper to tell that we are the tenants, its all kind of verbal, and temple trust people knows that we are the tenants), but since many years my father has been paying the rent and before him my grand father used to pay. Now, one of the descendants of those tenants have now came and saying that I will start a business in one of the rooms. Unfortunately my father never argued that this doesn't belong to them, what my father has told them is that they cannot run a business because we all are tenants. Now, our problem is this - if we go to the temple trust saying that he is trying to run a business then they will certainly make an issue out of it and they will try their best to throw us out of the house because since they a long time they have been trying to throw us out. And if we do not go to the temple trust and he runs his business then once temple trust comes to know about it, they will file a case against us that how we (as tenants) can give room on rent to someone else to run a business and using that argument then will try their best to throw us out. Really confused on what is the best thing to do in such a situation! If someone suggest that we should send a legal notice or file a case against that person then my concern is that my father is bit hesitant in taking this matter to court, I know I can easily do that but I live outside so preferably I would like to avoid such a situation. But I know that if need be then I will handle it and I will drag the person in the court, but at this point what I want to know is - (1.) what is best way to handle this situation? (2.) if we take any legal action against that person then on what grounds he can file a counter case against us? Do he have any, in any way, a case against us? (3.) should we proactively take legal action against him or should we just allow him to run his business and take a wait-and-watch strategy.

A. Dear Sir, Neither you nor any body has the right to run business in the trust property. Best option for you would be sort it out amicably. Shanti Ranjan Behera Advocate

I am 21 year old girl student. I have inherited my deceased fathers residential 22 year old flat. Other than the original copy of the deed, which was misplaced and I could obtain the certified copy, I have all the legal documents, like title suit change, mutation tax all in my name. Now I am in dire need to sell the property. But buyer's lawyer wants the original copy which I cant produce. HC has given me the title suit that I am the owner of the property. Please advise me how can I sell the property with the certified copy. My other legal documents are alright.

A. Dear madam, File an Affidavit that you have lost the Original and if somebody got it and return it to you will be suitably rewarded. Failing which you will apply for Certified Copy and on the basis of that you will proceed for Sale of the property. Shanti Ranjan Behera Advocate
