Mera second marriage hai.mere beti ki mere second husband ne legally adopt Kiya hai Lekin wo hame Abhi sambhalate nahi Mai Abhi Papa ke Ghar aayi hu.wo muze paise nahi dete.5 year hogaye shadi ko.wo muze physical and mental harrassment Kiya hai.unake pass mere proof hai muze fasakar meri bolane ki recording hai aur proof hai wo muze maintenance nahi Dena chahate meri beti ki jimedari nahi le rahe hai. Kya muze maintenance,house and beti ka maintenance mil sakata hai kya? Mere pass koi proof nahi hai wo mere khilaf plan kar rahe hai.proof lagate hai kya court Mai. Mere behan ki Abhi shadi hai mere Papa expire ho Gaye hai mere pass kuch paise nahi hai.jobless hu mai.first husband expire ho Gaye hence second marriage kiya.unake thode paise hai Lekin Papa ke treatment ke liye kharch ho gaye.please help me Mai kya Karu Abhi give me solution and advice

Hi, I have a divorce case on going with my wife. She lives in other city. I have a house which I m trying to sell. My wife came to know about it and she has given a false public notice in the newspaper that she has 2/3rd right in this house and anyone dealing with this property shall do do at his own risk. My question is as she has given this false public notice to mislead people and create trouble for my house sale, can I file a police complaint against her ? Will it be useful to take this to police ? Else what other possibilities are there to take action against her ? Thanks

A. Dear Client, As there is a divorce case going on between both of you, she has got every right to claim your property provided your property is self-acquired. You can do as advised by Advocate Shivangini. Transfer your property in the name of your father or mother, hence, in that case, your spouse loses her right to claim it. Thanks.

I need to put up a medicolegal case against someone. What if in case the court denies accepting my case? What can I do in that case?

A. If you have a valid ground to prima facie prove that you have a medical negligence case then the court will norlt reject. Also of the case is rejected you can appeal the same before a higher court

I got divorce 6 months back. MoU was signed b/w me and my ex wife that we, our family members, relatives will not file cases against each other in future. My mother did not sign any where. my mother wants to file DV case or defamation case against my ex wife because she written name of my mother and Sister in false 498a etc cases that spoiled her reputation. This will be called breach of agreement ? MoU signed be me and my ex wife is binding on my mother? Can i surrender the rights of my mother regarding filing of case ?

Can the high court decree(court order) can be challenged and further fight against a decree which has no understanding of the real scenario. Because my case has different point of opinion. But the judge is too adamant and stubborn. Foolishness is the word i call for the lady judge.

My uncle stood as a guarantor for a bank loan in a nationalised bank. Borrowers escaped and declared as exparties. Loan became NPA and Guarantor only contesting the case now. The case was proceeding since 10 years. Now the guarantor health is not good he may die at any time. In this situation what will happen in the case? Can guarantor son/daughter have rights to contest and continue the case? If yes then what is the procedure to do? Note: Merits are there in guarantor side. Bank done the fraud in this case.

A. Hi Yes after the death of the guaranter an Application for substitution of legal heirs have to be filed to bring on record the legal heirs of the guaranter and therefater they can contest the same. Sir My husband tortured me right after marriage for not meeting dowry demands.they kept on doing and showing their frustration either by passing comments ,or fighting,or hitting,or asking money,he earns 1lakh and still is a miser ,doesn't want to spend money on me and my girl. Last 4 years back he suffered cancer but was soon cured then he again started same things with me .now I became more unlucky for him.his family even treated in a similar manner then he asked me to leave his house .and from two yes I m living with my parents.he filed a divorce case .in reply 498 a fir registered by police but police after 5 months is closing fir in court .don't know why I showed them proofs of dowry given but still .my father in law is a lawyer and influential person .i m really frustrated till today I m suffering and he is enjoying .I thought he will be under pressure after 498 a but now what to do.is 498 a done by court but my lawyer told me to go directly to police.

A. Mam , it is recommended that you challenge such closure in the court and also move applications like 1. Domestic Violence u/s 12 of the PWDV Act 2. 125 Crpc for maintenance If you want to pressurize them further. 498A will go as a separate case and in all likelihood they will get either a bail or anticipatory bail. It will not help you of your problem of not getting money. Thanks
