I got married 3 months back in court and got an Aryan samaj marriage certificate. I want to dissolve this marriage. What to do next.

A. dear client arya samaj marriage procedure is legal. for getting divorce you need to file divorce petition before family court. go through local family court lawyer.

There are two sons and two daughters of a married widow. She wills to give all her husbands property (which is in her name) only to her younger son as her two daughters are married and her elder son is currently staying apart from them and totally not taking care of the mother and his younger brother. Can she transfer all her husbands property (which is in her name) to only her younger son's name.?

A. No.
Widow mother cannot give her husband's property to her one son to the exclusion of other son even if the other son is not taking care of her. She is required to divide it equally among all children.
If daughters are not interested in that property, then the property is to be divided between all the sons. However, daugthers' signatures will be required on partition deed.

Hi, I filed a complaint (GD) against the unwarranted , derogatory and threatening incident . Police didn't responded and then I wrote letters to senior officials to attend the same and lastly when nothing happened, I put a public Grievance after which the Police Chowki in charge called both parties and matter was resolved taking resolution statement from me (Complainant). Now I want a copy of this statement/Closure statement ..But inspector said this Cannot be given except with RTI . This seem to be unjustified as Initially, before going the grievance way, the complaint was lodged as a Police complaint. Are they correct in saying so.

A. I am not writing how to get the closure report as that part has already been taken care of by the other panel advocates in this forum. In addition to that for your understanding a closure report by police cannot be accepted as gospel truth, as police is not the final authority on people complaints. A closure report is not the end of prosecution. You have a right to file your complaint before a magistrate narrating identical charges. Do I need to get groceries and ration separately besides paying alimony to her. Not divorced yet but live separately.

I am Central Government employee in department of post, currently deputed in post office passport sewa Kendra, in post office working days are Monday to Saturday where is in passport office working days are Monday to Friday now the postal authority is pressing us to attend the office on Saturday also ,but we are deputed in passport office, can I avail Saturday off as the other staff of the passport office as I am deputed in passport office.

A. No. You should be attend your office at Saturday as well. you are abide to attend work and follow
procedure provided by department. But problem is that you are deputed by one service to other service. That might be affect your facilities. Approach to office of nearest vidhikarya lawyer and get proper advise for filing suit in CAT.

Hi, My divorce case is under process. My wife has filed interim maintenance by highly overstating my income. My case is if I don't attend dates, will the court Grant her the interim maintenance as per her wish ? Thanks

I got involved in a minor accident a month back. We were driving our car and by mistake while crossing road a speeding motor bike hit us and he fell down. There was a old lady in the bike who was injured as well. We then took them to hospital and in hospital doctor said it was just minor injuries and not so serious and treated them. We also paid the necessary compensation for that, however they made us to write a letter stating the same. we wrote that we paid so much amount and settled, and if in case there are any further problem they can reach us . We just wanted to leave the scene as there were too many people in the place. Now after a month they are calling and asking for more money stating that there is more to pay or they ll file a case. I asked them to go a head with filling a case and we ll deal if they file and I blocked the number.they tried reaching from different number but I didn't pick the call. Kindly let me know on actions to be taken from our side.Questions from my side are 1.Should I have to take some precautionary steps like take bail in advance and will I be able to?? 2.I felt that I have no other choice to face this legally. is this the right way now? 3.will they be able file and proceed a case in this matter? Some other details : my vehicle is a TN registration and the accident happened somewhere in Karnataka close to Mysore road

A. let us know whether any receipt of compensation paid to them is with you or hospital records of the victim treated in the hospital iun connection with that accident

I want to file a RTI against Consumer Forum asking that why my case is being delayed. My case is matching with a pre-decided case decided by National Consumer Forum. Will that decision given by NCDRC binding on District Consumer Forum or it will act as a precedent?

Hello sir, I am a primary teacher in Uttar Pradesh govt. I am 4 months pregnant. I have applied for inter district transfer from Azamgarh on the ground of husband's working place and residence in January 18 and get transferred to my third choice Bulandshahr in june 18. During councilling basic Shiksha Adhikari appointed me to a school which is 130+ km away from my residence. It is impossible for me to travel this distance in this condition and doctors have also forbidden me from traveling long distances. I tried to communicate this matter with my basic Shiksha Adhikari and district magistrate of Bulandshahr but they denied any kind of support. Please suggest me what I can do now?

Hello, I have given my flat on rent to a group of working professional boys ..however, some apartment owners always have concerns and want me to give flat to family only. Our apartment society has not been formed or registered . It is managed by some group of owners and every time they come up with there set of rules who are staying in the apartment. These owners frequently call me to trouble and say they will lodge a police complain of any matter even for no issues they create some and try to harass .. I want to clarify on 2 points 1) If I have an official rental agreement, police verification done for tenants is there anything else I need to do safeguard from such neighbors harassing by blackmailing that they will go to police 2) I am not sure if there is any rule from Maharashtra government, not to allow visitors of the opposite gender in the flat during normal day time

A. Legally Giving flat on rent are not objectionable.but if neighbour disturb you then you can file private nuicencs case .
