i had purchased a property in 2005 in ten lakhs and now i want to sell the property in 2018 and i can sell the same @ 40 lakhs. pl let me know if i have any libility of income tax? secondly i intend to distribute the said amount in equal part to my two daughters and my son and his wife. is there any libility of gift tax if any?

A. Dear Sir, The property in question can be sold at any price. There is absolutely no BAR at selling price. In relation to Income Tax query, yes you will have to IT on it. Since, it is a long term holding property from your side you will have to pay Long term Capital Gain tax on the property. In relation to gift tax query, tax is not levied on gift (cash or kind) if it is given at the time of marriage. If you want to save gift tax, then you can consult for further advice in this regard.

A. Dear Mam, The ACT of your boyfriend calls for strict action as it involves a lot of offences. You should start by lodging an FIR against him for harassment, black mail etc. Secondly, you should send him a Legal Notice asking him to stop the nuisance otherwise he will have to bear the dire consequences for the same.

My husband transferred all money and property to his brother account.now he said he don't have money for maintenance. He said he is not working at present,while I know he works from home but earning lots money.but I don't have proof .then what should I do ?

A. Dear Mam, It is not relevant whether he is earning or not. Maintenance is an statutory obligation and that needs to be paid. Since, you are telling that he is not paying maintenance, then either you have allowed interim maintenance or your maintenance case has been disposed off by the court. You can file a prayer before the court stating that your husband is not obeying court orders. Court will take action.

Landlord handed over the shop key on Dec 15th & demanded the rent from that day & it took more than a month for interior setup, business operated on 18th Feb. After running the business for 3 months without much revenue to manage i decided to quit in May18 & informed landlord in advance as notice period. June month shop completely closed & i paid the rent without any income & informed landlord that by month end i will vacate the shop & handover. But landlord says he will not return the deposit till he find new tenant. I believe thats not correct. Pls advice.

My husband died few days back after his death i came to know he has taken few personal loans and there are few credit cards bills too solely in his name. He died suddenly only in at a age of 35 he was the only earning member. He has not left any property. Is i am liable to pay his debts. As i am not working and have a 5 yrs old kid to take care of and his old parents with medical histories. Kindly help.

A. Dear Mam, There are two things that you have queried: 1. Loan: You will be liable to pay if you are the co-borrower or co-applicant. 2. Credit card: You are not at all liable. The bank can attach the property for recovery but through court. In case you are harassed, please contact Vidhikarya for an instant help.

I am Hindu married female.My great grand father got land property,died in testate in 1980. My grandfather his brothers on succession partitioned the land in 2009,.My grandfather having self acquired property also died intestate in 2014.My grandmother died before in 2007.My father,his brother being successors enjoying properties jointly since 2014.My father,mother,brother,myself are our family. When I ask my share of ancestral properties,my father refused saying that my great-grandfather property lost ancestral characteristic due to division in 2009 and my grand father's property became absolute to him as self acquired and he being class 1 successor of my grand father,absolute rights lie on him alone during his life time .Is the stand of my father as per law. Please advise. Thanks for sparing your valuable time.

I stay on 3rd floor and the plaintiff stays on 2nd floor. We have allowed Plaintiff to get the water leakage repairs done 7 times but he says that the problem is not solved and water is still leaking. We denied any further repairs and asked him to get the repairs done from some expert. For this he complaint in police station and also issued legal notice, where he completely denied that repairs were done 6 to 7 times. There is no proof for the earlier repairs done and we asked him to acknowledge in writing for the repairs done for which he denied. Me and family are facing problems due to repairs again and again. Plaintiff has issue an injunction against me. Please suggest what to do ?
