Hi, My grandfather has 1 son,3 daughters. He got 20 acre land from his father, it's his father's and grandfather's own property. 3 daughters got married and they have divided this property which means 10 acres are sold for there weddings. My grandfather expired 2007, Now my grandmother has 3.5 acres on her name.we are daughters of his son, are we eligible to get his property and who else has rights on fields now.

A. The distribution of inherited property is done according to Hindu Succession Act and according to that Act as amended from time to time equal distribution among the legal heirs is to take place.

Sir, I have filed one consumer complaint before National Consumer Dispute Redressal Forum. My complaint is marked as deficient by the registry for want index. Please provide proforma / format of the index as applicable to above mentioned forum. Thanks in advance.

A. The Consumer Complaint along with all the copies should be paginated and duly indexed in the following seriatim: 1. Index 2. List of Dates 3. Memo of Parties (with fresh complete addresses & telephone no.) 4. Complaint with Notarised attested affidavit 5. Supporting documents in favour of complaint e.g. receipt, voucher etc. (All the Annexures must be attested as True Copy on the last page with name & signature) 6. Application for condonation of delay with Notarised attested affidavit, if beyond limitation. (2 years from cause of action) 7. Fee for Rs.5,000/- for making Consumer Complaint (Demand Draft in favour of “The Registrar, NCDRC, New Delhi”)

Hi I have joined phard d in 2011 and due to family issue I discontinued in second year . Two years fees had been paid . When I asked for my certificates college administration ask me to pay remaining 4 years fees They are asking me to pay 3 lakhs rupees which is very high for middle class family like us .. it's been six years they are torturing me .. I want to resume my studies this year How can I get certificates to me legally is there any such law which can help me

Can builder change the per sqft price at time of possession from what was signed in agreement of sale at time of booking.

A. In order to change the price or any clause in the agreement which has been signed and sealed by the parties,m then in writing permission needs to be obtained in prior until and unless the agreement specifically empowers the party/s to change the clause.

Me and my wife married in 2014....due to adamant nature, me and she gt seperated on oct 2016. I filed a rcr case in november 2016...and sent lawyer notice and court notice to her rented house. She didnt receive and neither turned up for hearing. I published in newspaper thn also she didnt turn up.....after one year, in november 2017, in bangalore, she filed a protection of women case in mmtc, bangalore.....what should i do now?mine RCR case is towards ex-partee.waht should i do....

A. Her non-appearance in the RCR matter is making her case weak and towards your favor. You should take the order of the court in RCR case and prove the same before the Ld. Court at Bangalore and the same is expected to help you in the latter case.

Hi.. I am a 25 year old single parent..I got divorced a year back..I have decree under guardianship and wardsp Act awarding me guardianship of my 1year daughter..my divorce was mutual consent..subsequently after child birth the hospital authorities issued birth certificate including her father name..I don't want to add his name in anyt documents..I came across supreme court judgment ABC Vs.NCT where mother name is sufficiently enough in any legal document..my question is there any specific government order to substantiate supreme Court order..can I apply for further legal documents with my guardianship decree alone...pls advice rationally

A. The judgment of the Ld. Apex Court speaks for itself and have to be followed by every one. The government (Ministry of External Affairs) had made modifications in the processing of applications of passports with the name of one singe parent and not for both. You can apply for legal documents using your guardianship decree.

Dear Sir, I booked 2 shops in greater noida, u.p. with a builder. I reside in new delhi. Builder promised delivery of shops in march 2018. I have not signed any AMU, but he gave offer in mail mentioning about project , payment and delivery of shops. We also verbally discussed about the same. But construction has stopped sometime ago. Due to funds or NOC etc. Builder has a regd office in delhi and head office in Gteater Noida. My questions are :- 1. can I go go to consumer Court for shops/ shops are purchased for personal use? 2. Since I reside in delhi and shops are in u.p. can I go to consumer Court in delhi.

A. In response to your query, please find the answers: 1. You cannot go to the consumer court for shops related issues because you do not get covered under the definition of "consumer" as mentioned in Consumer Protection Act. 2. Since your second question is in direct nexus with the first question and the answer to your first question is in Negative Affirmation, therefore the answer to your second question is also a No.

Dear Lawyers forum, Please help on how to act on the below : I have quit my job on November 3rd 2016 after serving four months from a telecom company. I have received a call from the Hr in November 2017 urging me to pay the recovery amount of 27k as stated in the full and final settlement. As per the FNF calculation, they have added a column called recovery 22k. But, I have no idea as to what lead to the amount 22k. There is no break down. When I have questioned the HR regarding the same, HR has vaguely responded by saying it is relocation expenses. On further questioning, the HR replied that these are coats for staying in the hotel during and orientation and relocation etc. I have received a legal notice asking me to settle the amount without any breaking down on what indulged such expenses. On several instances, I have paid my own bill for hotel and vehicle transport. I have receipts of the same. Further, the appointment letter which I have signed clearly mentioned that I am only liable to 1 months basic salary in case of quitting before 1 year. Please let me know how to about this. A. Dear Querist! As per the matter posted by you it is evident that you have yourself paid the hotel bills etc and you did not receive any reimbursement from the company. In this case the amount of 22,000.00 as reflected in the F&F is not appropriate and therefore you are not liable to pay any amount.Since you have received a Legal Notice it is recommend that you reply to that Legal Notice and also demand compensation from the company for false allegations including pain and suffering.You may contact or further details.

A. Hi! Your matter is not very clear. Do you want advice for correction in the spelling of your surname on marriage certificate or do you have some other query because the maiden name is written on marriage certificate and on the basis of the marriage certificate you can change your surname in other documents. You can consult ahead to have a concrete solution for your matter.
