Me and my wife both are wiling to take mutual divorce now after 1 year 2 months of marriage life and we have 3 months old baby girl. Now my wife does want to take child custody. Is she legally do so? If she doesn't want take custody of baby, is she bound to bear 50% of child maintenance expenses in future if child stays with me. Please note my wife is a working woman

A. 1. It is always suggested for the mother to take child custody ( if the child less than 3 years of age ). 2. In case, if mother does not want the child custody then you can maintain the kid. 3. As the mother is working woman, she has to bear the expenses of maintaining the kid. Only court can decide the maintenance by the working woman. But, there are SC citations where 75% of child maintenance paid by the working woman.

A. 1. Sending obscene words through social media / internet is the cyber crime offence u/s 67 of Information Technology act. 2. I suggest you to issue legal notice to her for apologizes.

Sir my brother addicted to alcohol n my entire family is suffering by his torture....he harrases his wife n we are worried about his child ....my brother abuses evryone whoevr tries to control him ...mainly he tortures his wife and child...we complained about him in our near by ps but could not find a sulution....sir pleas advice us how to control him as per law .....his wife our sister in law sufferng a lot..

A. 1. As police have not taken any action against him, I suggest you to approach a lawyer to take up your complaint to court. Court would pass orders to police to file a FIR against him.

A. 1. Just because you need financial support, you do not have to bear his extra marital affair. Now its extra marital affair but in future, it may extend ruining your life. 2. Committing extra marital affair is an offence of 'Adultery'. 3. I suggest you to file a police complaint against him under the charges of Domestic violence, Harassment,Adultery .. etc., 4. Better consult a lawyer before initiating cases against him.

Dear Sir, my father was a government employee. He expired in 2015. My mother is a housewife and pensioner. Now she received a letter from Naval dockyard including an order from Central Administrative Tribunal (CAT), HYDERABAD, that my father was overpayed during his service in 2013, asking us to repay now. There is no copy of evidence shown to us. How should I respond now. Further with a valid proof (if any), should I repay?

I have a very less known friend who was living with his wife. They both know me after some casual meetings because the husband and I works in same company. After sometimes I came to know they are not married and he left his wife now the wife has filed a case. Can I be called as a witness? And I don't want to be the witness bcz I don't know much about them what will happen? In short I don't want to be a witness what should I do? They are from another state and I am from another state.

Hi Sir I work for a small firm and we were approached by a big company to tie up with them. The agreement was I was supposed to pay them commission for each lead they offer. The agreement (draft copy) was shared via emails and we were asked to do the franking of the same. Before we could sign the same, we were asked to take up the lead and things went awry. Now the company is threatening to sue me. In one of the emails I had mentioned that I accept and please proceed. Will this be treated as acceptance of agreement eventhough I have not signed it. Hi. A few months ago my colleagues contacted me saying they have joined a business venture which is related to e-commerce, buying and selling of products. They approached me by saying that a position is available at the company and they would want to freeze that position for me, I was neither informed about the company nor the job role,since I trusted them, I transferred 1,50,000 into my colleague's account. They revealed the name of the company later,along with what the job entitles, there were a lot of negatives with both the company as well as the job offered. Therefore I refused to sign any documents related to it. When I asked my money back on the same day the money was deposited, he mentioned that he had already paid the amount to the company. Is there a way to get back the money, what kind of lawyer am I supposed to approach? Any answer would be helpful. Thanks!

A. 1. If you issue legal notice then they would would issue reply notice. This would go on and go on. 2. I suggest you to hire a lawyer and file police complaint under charges of cheating,forgery ... etc., 3. Once the FIR is filed against the person then he would come for settlement.

FEW MONTHS AGO I HAVE LEFT A PARTNERSHIP BUSINESS BY MUTUAL CONSENT BEFORE LD NOTARY AFFIDAVIT AND PUBLISHED IN NEWSPAPER, WHERE HE HAS TAKEN ALL THE LIABILITIES OF THE COMPANY ACCOUNT WILLINGLY. BUT AFTER 4 MONTHS MY EX- PARTNER WAS ASKING ME FOR MONEY (ACCORDING TO HIM HE HAS MADE LOSS IN BUSINESS) AND MENTALLY HARASSING ME OVER PHONE THAT HE WILL SUICIDE WITH A NOTE MENTIONING MY NAME. SO I HAVE GIVEN A DIARY MENTIONING ALL THE DETAILS WITH CALL RECORDINGS. SUDDENLY 2 DAYS AGO HE HAS TRIED TO SUICIDE BY HANGING HIMSELF AND LEFT A NOTE WHERE HE HAS SAID I HAVE BETRAYED HIM. HE WAS SERIOUS AND ADMITTED IN HOSPITAL, BUT NOW HE IS DISCHARGED & PHYSICALLY FIT. BUT NOW POLICE IS REGULARLY COMING TO ARREST ME/PARENTS AND WE ARE RUNNING ONE CITY TO ANOTHER AND OFF MY PHONE. WHAT TO DO? PLEASE HELP ME ASAP.

A. 1. Until and unless police register FIR against you, they do not have right to come to your home and harass you / your parents. 2. I strongly believe that they are trying extract your money. 3. You may file complaint with higher officials of those police officials who visited your home and harassed you.
