A. HI
The tenant is liable to pay rent even during lock down period and tenant cannot claim any privilege such as force majeure or lock down in support of him not paying the rent.
So, as a land lord, you can claim the rent in full from the tenant during the lock down as well. So the position of law is that the tenant is liable to pay the rents to the land lord under the present lock down circumstances as well.

Now the question of land lord discussing on rent with tenant is purely a commercial o ...ReadMore

A. Hi
You can always escalate to the nearest police station under NUISANCE against the bank and its customers.
Since it is the legal responsibility of the bank to maintain hygiene and also to adhere to parking regulations, you should complain to the police station.
Please note that in law, the neighbours right for peaceful possession and enjoyment is paramount and all neighbours need to ensure that neighbour's rights are not trampled.

A. You seem to have several misconceptions. Your issues arise out of agreement only which contains arbitration clause so you have to exhaust arbitration clause. As such there is no arbitration court. On expiration of lease, the arbitration clause and other clauses like damages etc still subsist. No civil court will interfere in the matter when arbitration clause exist. Fee is decided by the arbitrator only. Fee is shared by both the parties but fee is non refundable. However, if you win arbitrator ...ReadMore

Posted 1 year ago

A. Hi
The government of india has invoked disaster management act and as such certain fundamental rights pertaining to travel has been suspended.
So if at all you have any necessity , you can obtain travel passes from your police station who in turn will grant you passes for inter-district travel. Courts have said clearly that if there is any emergency, citizens can obtain permission from police and travel.

My question is does mens rea or intention matters in cyber crimes or is it a strict liability law. ( Under IT act 2000)

Posted 1 year ago

A. HI
Mens rea is not a requirement but is rather a general rule under the penal provisions of the IT Act.
The element of mens rea in Cyber-crimes is that the offender must have been aware at the time of causing the computer to perform the function that the access thus intended to be secured was unauthorized.

Posted 1 year ago

A. HI
It is against law for banks to deduct / charge their customers for add on products like health insurance etc.
You can either approach the banking ombudsman or file a case in the district forum for deficiency of service (in law , charging for add-on's without consent of borrower is deficiency of service)
Hope this information is useful.
