icon Divorce for sexless life

Hello, I got married on 26th April 2021, and till date I didn't had sex with my wife, as she is refusing for it. I waited almost 2 years educated her, took her to the doctors, counselling and all, now

A. Hello
You cannot force your wife to have sexual relations with you forcefully. You must have patience. Although if you want to filr for divorce you could do so by filing a divorce petition under the hindu marriage act. Also you must have been living seperately for atleast 1 years to file for divorce.

icon what to do if police station submit unfavorable report in 156(3) to court

Last year , I've filed private complaint petition under section 156(3) in JMFC court for registration of FIR against respondents for crpc 378,379 as police did not take any action on written complaint

A. hello
the court would be give you reasonable opportunity to you for filling objection against that report and for presenting your side. Also if you think that the police investigation was biased then you could ask for fresh investigation and changing the investigation officer.
Thanks

icon Age limit for loan

What is the age limit for obtaining loan?? Can an 80 year old lady obtain loan along with Son less than 60 years against unregistered ancestral property having different stakeholders??

A. Hi,
You must be at least 21 years old to apply for a loan. Paid employees can be 60 years old at the time of debt maturity, whereas self-employed professionals can be 65 years old. Age, on the other hand, varies depending on the bank. Some lenders prefer to lend to persons above the age of 23.
Thank you very much.

A. Hi,
It will not be difficult to obtain the property if it is in someone's name. If a man dies intestate, that is, without a will, his assets are dispersed according to the Hindu Succession Act, and the property is passed to the deceased's lawful heirs. In the event of intestate succession, the mother is entitled to the same part of the estate as the other lawful heirs.
Thank you very much.

icon None of the other 3 sisters have claimed any possession of the property till date. Now we want to sell the property

Hi My great-grandfather passed away before 1950 without a will, leaving behind 3 sons and 3 daughters. The 3 daughters were subsequently married and have all passed away now and one of the son passed

A. Hi,
Firstly, the legal heirs of the 3 daughters does have a valid claim of share in the property, you cannot deny them their share. The share of the deceased unmarried son would be passed on to his surviving brothers and sisters. The property would be distributed amongst all the legal heirs of your grandfather, including the daughters and sons. Their share cannot be excluded.

You can give a police complaint for the same. Send a copy of that to SP office too. They don't have any right to obstruct you from entering your land in any ways without a court order. You can approach court and detail the issue.
