A. Dear client,

A. Dear client,
Section 313 of the Cr.P.C. gives power to the court to examine the accused. It provides an opportunity to an accused to tell to the court as to what is the truth and what is his defence.
The accused can be examined under section 313, Cr.P.C. in every enquiry or trial.
As per section 2(g) of the Cr.P.C.:-
“enquiry means any enquiry other than a trial conducted under this Code
by a Magistrate or Court”
The trial of the accused commences after framing of charge.

My father died when I was 12yrs old, now I have my self acquired property in delhi and POA of that property is my wife now my elder brother us asking for partition of that property. What can we do?

A. Dear Client
It is not clear from your query as to against what property your elder brother claims for partition. He can not claim share or partition of your self-acquired property. However, if your deceased father left any property intestate which is occupied by you, then your elder brother can claim a share of that property following the law of inheritance and seek partition of that property.

A. Dear Client,
If the terms of your construction agreement say that for any deviation in construction work or for breach of any condition of the agreement, the agreement stands terminated serving a notice to the contractor, then serving a legal notice terminating the contract you can file a civil suit for recovery of money already paid against the contract along with compensation for breach of contract. Reach out to an Advocate for guidance and steps.
