A. dear client in your matter It depends upon case to case high court to court and j even udge to judge to judge also. However in case of a urgent and genuine case, u can file an application for early hearing if there is no date of hearing and if it is rejected then move supreme court for a direction to high court for early disposal of the case.

Can I counter any petition on my wife to avoid maintenance charge, domestic violence and dowery case. She is working since 6 years, but she wants maintenance charge. She don't want to stay with me even her family members also don't want to continue with this relationship. She and her family members lots of time threats me on the call. I have some proof like call record and what's app chat against her for the same. She wants divorce but not a mutual consent. How can I defend from my self can you please guide me.

A. dear client in your matter Petition for maintainence can be challenged only on two grounds in your case firstly that she is residing separately on her own will and has sufficient means to support herself.so far divorce plea is concerned, it will depend upon facts brought on the file by the parties. You can file Petition u/s 9 of Hindu marriage act for restitution of conjugal rights

To get plan passed by poursabha. What should I do ?? How to get dalil with their name. How can we devide the same in three brother ?

A. dear client in your matter Kindly find out the daag no. and khatian No. check in the BLRO and also in the Pourasabha by whose name the tax bills are coming. Check whether there is mutation done in the name of your Grandfather or Grand Mother . Then you need to make one legal heir certificate after that mutate your names in the property.

Hello sir, Would like to acknowledge that I have a property worth more than 40 lakhs and due to unforeseen circumstances we are trying to mortgage it to a friend who is ready offer the amount but the scenario is he is asking us to register the property on his name & then have registered MOU in place that would help to have the property's hold on us. I would request you to guide us on this and how to take this further
Share this questionShare Icon

A. dear client in your matter There are strict money lending laws applicable to us. It would be recommended to mortgage with a bank or approved financial institution, otherwise you might end up in legal tussle with your friend. There are many cases which are pending for similar kinds of issues. For, any further advice, you may consult.

Hello Sir, I have purchased a plot on 26th October 2014. Now I am able to know the same plot has been sold by someone else to other person on 30th October 2014. But from last 18 years of EC record who sold to me is seems the legal owner. So my query is now, can I able to build house on that plot? Is there any chance that after I start building the other party will be file complain. If he files complaint then what will be happen? Can he able to file against me?

I am a resident of New Delhi, Malviya Nagar and work in Gurgaon. I live here with my husband. My 1 year old daughter is currently residing in my home town in Jharkhand with my parents. After my maternity leave got over, I could not arrange for a regular full time help which is why my husband and I jointly decided to let our daughter stay with my parents. My parents are retired and hence are able to take proper care of my daughter. My in laws have refused to support in any way till date, however now they want to keep my daughter against my express wishes. My father in law, though a teacher by profession is used to substance abuse and is known to be a drunkard. I do not want my child to be subjected to such environment. My in laws have actually visited my parents and threatened to take legal action against them and forcefully take my daughter. As far as i can see, i feel the reason for the sudden interest in my child is to somehow use her as a means of additional income from us. My husband is a silent spectator in all this. Please help. What options do i have?
