I am 18 years old and a female. My father is extremely violent by nature, and threatens me with physical violence whenever I refuse to obey him, provided that I have my own perceptions which at times do not match with his own. He has caused me extreme emotional and physical suffering (included kicking, punching, strangling and pulling my hair). He has physically abused me many times in front of my siblings. Only yesterday night he threatened to kill me if I ever disagreed with him or came between his relationship with my mother. I have been accepting this abuse for a long time only because I felt that he was my legal guardian and corporal punishment is legal in India for parents, but now I'm an adult and refuse to accept such treatment. Please help me out.

A. Dear, As you are a major now, you can take decisions of your life on your own and move out of the house if you wish to. You can also take the help of the police in this regard and file a case of domestic violence against your abusive father. You are entitled to claim maintenance from your father as you are not able to maintain yourself and still dependent on your father. You are also entitled to claim maintenance from the share of your father in the joint family property if any. The personal legal obligation of your father to provide maintenance is continued till you married.

I want to Know whether I can file for domestic violence case after my husband sends divorce notice first?

A. Madam, You can file domestic violence case against your husband any time. There is no need to wait till your husband sends divorce notice from the court first to file domestic violence case against your husband. If the domestic violence is happening and continuing, you can immediately report the matter to your area's protection officer who will after inquiry, prepare and forward a Domestic Incident Report to the concerned magistrate court under whose jurisdiction domestic violence is taking/took place. Thereafter, engage an advocate and file petitions in the court for protection order and residential order against your husband.

If the matter is under sub-judice can any action be taken in the same matter against the party involved by any appropriate authority. Kindly advise the exact legal position.

A. Criminal and civil proceedings can go at the same time. For a better opinion, take personal opinion after showing copy of relevant documents.

This would be big text, please bear with me. I bought a flat from one of the renowned builders. The property is a A khata property with all the proper documents. After one year one day I received a notice stick to door stating to pay "Axis(not my lending bank) bank outstanding loan balance" addressed to some other person "X". As my name was not there I did not take it seriously but I was concerned of fact the address mentioned in the notice was same as mine. When I checked with the builder he said "X" is one of the director of builder firm, he has done some fraud using his powers and now he is absconding. My apartment consists of 400+ flats out of which only 2 (including mine) flats has this problem. The property is registered in my name and my question is how can two banks give loan on the same property. When asked my builder gives reason that the property is in your name you need not worry.

A. Lodge an FIR of cheating with the police immediately.

Hi, My father filed a suit for cancellation of regd sale deed executed by his elder brother on the Joint property. He filed Arbitration partition document along other required documents in court. The case got dismissed on default ground subsequent to the death of my father. They sent the file to the District court. I have filed a CA to check on the case details. I got a response stating that the documents were missing. I got the acknowledgement on the same through RTI. Kindly suggest what should be done now. Thanks Thayagaroyal G

A. You may use the certified copy. Lodge complaint with Registrar Vigilance High Court.
