For my marraige my parents were finding girl so one of our family relative suggested a girl from nagpur.one of my cousin brother's wife belong to nagpur so we just queried about the nagpur girls and their backgound with his wife this turn into whats app communication on regularly basis one day she proposed to me and asked me to marry i tried to explain here that you are married and this relation belong in our family so it will not be excepted she told me that she will give divorce to his hsuband and marry with me.i have told that this is not possible we can be just good friends she told me that she is not happy with him her marraige has 10 years life and no children the age diffrence between both is 18 years here marraige was also done at the age of 16 at that time her parents were dead she had no intention to marry with my cousin. after marraige she had daily fight with my cousin she move away to his sister house in nagpur but my cosin manage him to bring back some how. we have purcahsed new house and i invited to her to pay visit our new house as i was having some emotional feeling with here. my parents invited here along with my cousin but he did'nt come and sister in law arrived alone.she stayed at our house for 21 days she was happy at our home she treated my mother as his mother.as the day one she move away from my house to her home back immediatly she demand divorce from my cousin and whole gun point was move towords to our family. my family tried to asked him why she is was doing like this and my mother told him dont expect him to marry with his son.my family doors were close for her mean while our communication was continue on mobile and i tried to convince our marraige is not possible and if its after and after only divorce she told me that she will manage with my cousin. meanwhile my cousin threated me not to comunicate with his wife and i told that i have no such intention and ask him to convince his wife . however our communication was still onn she was telling me that once i will give divorce him & i will marry with you at any cost. after nagpur visit was over she came at my house for 4 days without my parents knowladge and my parents here also not at my house. after 4 days she gone back to my cousin house and explain the situation to police that whatever she is doing, is doing with his own mind no one is trying to do. police give 2 option 1 my family except here else 2 i will give underwritting on stamp paper that me and my family have no relation with his wife . At the same time my cousin launch police complain that my famaily including me has brainwashed his wife to marry with me and try to grab away his wife. my cousin never directly spoke with me or my familly reagarding this compain and on sunday my sister in law and one of his neighbour cum relative person come to our house thratend us badly regarding police complain he told us that his one phone will make our whole family behind the bar.police will come right now and arrest whole family you dont know what crime you have done.my parents are seniour citizen and were badly feard your every call details and msg details are with police. neighbour cum relative person asked us to make compromise with two option 1 i will give underwritting on stamp paper that me and my family have no relation with his wife else 2 i can marry her by giving him 5 lakh rs i just want to know best way to deal with this problem as police has never queired me ,can we approach police to know the fact of complain?

A. Dear Sir,
You are unnecessarily entering into a problem and it may lead to jail and your life will be spoiled. if she obtains divorce then it is ok. Go with second option by personally visiting police station.

Sir, I am mayank pushkar form U.P, i want to share some information regarding my rights on education i am sharing my matter with you kindly give your guidence. I married one girl in temple on 14 feb'18 in uttrakhand and it was registered in uttrakhand court on 27 feb'18, i am from Saharapur(U.P) and that girl is also from Saharapur (U.P). Now my parents did'nt know anything about this. After registration my wife is thratining me to take her home and if i'll not do this she will bring cops and make me and my parent arrest, sir i am a LAW student and giving my last semester exams everytime she came to college during my exams and creating a scene and giving me threat that she will file a fraud case aganist me and my family. Several times i told her let me complete my law exams than i'll take this matter before my family but she is not trying to understand and creating a problem and abusing me my infront of college colleagues. she is intrupting me in giving exams, so is there any way lagally to make her stop for not creating any issues till my exams are over? i want to give my exams with healthy mind she is now humilating me for that act which i did on 14 feb'18. Kindly give your suggestion and guidance through which i can give rest of my exams without any tention. I just want to know is there any way through which i can give my left over xams without her intruption. Do i need to give any applicaton to Police stataion to make her stop not to come to my college till my exams are over. Please guide me sir i am passing through a big trauma. i dont want to waste my precious year of my law session. hoping for positive response

A. Dear Sir,
First settle her life the in next you have time to write your exams. You can ask her to be streets. It is not good on the part of prospective lawyer. Be honest and you will be become a successful lawyer. Get lost with exams and take her to your home and convince your parents. Definitely they will bless you.

respected sir, sir i married one hindu gurl by register hindu marriage act but in 2 days they attacked me and take the girl away and they done her marriage after few motnhs we have no issue on that and they also have no issue aboutif o do other marriage...but by law now i want to know can i marriage other girl by court....pls tell me way to get separated bcoz i have no contacts with her or her family since 7 years. i want to do other court marriage pls tell the process..thanks

A. Dear Sir,
You cannot take advantage of her late marriage. Just file a formal divorce petition and see that ii is decreed ex parte and then go for marriage and disclose all these earlier happening to the family your prospective wife.

my father was died in my childhood.a partition deed was wrote my inherited property b/w my mother and my father brother when i was a minor.given property (my share)does not have way to enter fields.my father brother took road side property and he does not given any way to enter fields but equal shares has given . Now the question is can i file suite against my father brother to quash partition deed because it was wrote when i was minor.

A. Such suit should be filed within three years of your attaining majority. Try.

3 saal pehle mene mere college boyfriend se mandir me shadi ki thi bina kisi certificate ke hmari shadi ke bad apni femily ke sath hi reh rahe he taki pehle setal hi jae par ab mere pati ne dusri shadi kar li he. Mere pas meri shadi ka prof sirf photographes he to kya me police me complete kar skti hu uske khilaaf. Ya meri shadi kanunan nahi mani jaegi..?

A. Dear Madam,
Hindu law has no boundaries. You can prove it. Oral evidence is enough. It is believed in Indian Law that no girl accept any other male person as her husband without marriage. Try with police if they do not co-operate then go to civil and criminal courts.

After my father's death my brother is harrasing my mother for property issues.my grandmother made a will in his name,and now he wants my mother's property as well. We r two sisters and a brother.and my grandmother doesn't want to share her property,gold and bank balance with me and my sister.and my grandmother always threats my mother to claim her share in my mother's property. 1.can disowning my brother is the solution? 2.can my grandmother claim her share in my mother's property? 3. Can me and my sister claim our share in our grandmother's property?

My wife left my home in April 2016 after 15 years of marriage with my 2 children and fake allegations of DV (police complaints attached i.e. done since 2015 whereas she stated that i am cruel since starting of the marriage ) and illicit relations . She filed a Divorce case in August 2016 with false information in Income and Assets Affidavit which she withdrawn in Nov. 2016 with liberty to file again proper petition. In new Divorce petition she deleted some allegations from previous petition and added new allegations and also changed the facts in Income and Assets Affidavit from the previous withdrawn petition. We filed a complaint U/S 340 and application to dismiss the New Divorce petition by comparing old and new petition which they defend by stating that the old petition had already withdrawn with liberty to file proper petition, hence no action could be made in the matter. Q Do they get the right to change the facts in main petition and affidavit as well? In both old and new affidavit she did not disclosed the savings bank account of having more that Rs. 2,30,000/- clear balance which was increased in 3 months by Rs. 30,000/- which she took the cash from declared bank account and deposit cash in undisclosed account. In W. S. of complaint U/S 340 she admitted that the undisclosed account, she opened in daughter's name to save the money for her education purpose. Q Does above attracts action u/s 340? My present salary is Rs. 8,000 and she is getting Rs. 55,000 in hand. She submits a joining letter of mine salary of Rs. 48,000 which i worked only for the duration of 40 days in 2016 and i submit the email of Full and final from the company in support. Q Do still i need to pay the maintenance? If yes then please suggest expected amount as in Delhi, govt. minimum wages is Rs. 13,000/- approx. My wife and her CA cousin accessed my online INCOME TAX ACCOUNT without my consent, against which I approached to Hon'ble court in section 156(3) and recently the charge sheet is also filed in the court against my wife and her CA cousin U/S 65 and 66 (C) of IT ACT. Q. Does above illegal act will have any impact on maintenance case? Q. She purchased the scooty worth 55,000 on emi during the trail. Does it matters? Q Application u/s 24 and 26 is on order. Any expected suggestions?
Sir, My wife left my home after 15 years of marriage in April 2016, then she filed HMA Divorce Case in August 2016 with false facts in attached on oath income and assets affidavit which we challenge on wrong suggestion of my lawyer in Criminal court of ACMM in Sept. 2016. After that she withdrew the above HMA Divorce case with liberty to file proper petition after we challenge the affidavit of Income and Assets u/s 182 in ACMM Court. Now in April 2018 we have to withdraw the case as by law its non maintainable in ACMM court with liberty to file in proper court. 1. Can we file the above case in Family court again which we withdrew from the ACMM Criminal court? 2. Does it matter that the HMA Divorce case has been already withdrew by the wife after we challenge the same in ACMM Court and she filed the fresh case with new facts and allegations in the new case and new on oath affidavit for income and assets as her lawyer always state that there should not be any action on the withdrawn petition.
