The nominee who received the amount is in the capacity of Trustee to distribute the same among the legal heirs unless the nominee is having any Gift Deed or any other document to enjoy such amount by herself/himself. File a civil suit to get such amount from the nominee and also file interim application under Order 38 Rule 5 of CPC to attach her/his properties before judgment as a security for the said amount.

You have to contact advocate from Goa who is well acquainted with local laws. Generally when legal divorce is awarded by any Civil Court then the spouse has to wait for 90 days from the date of judgment to get to remarried.

It is common sense that nobody will believe especially the Bankers are not authorized to issue NOC before clearing the pending credit card dues of Rs.40,000/- though it is not connected with car loan. Such circulars are being issued by their head offices. Anyway you can sort out the matter by approaching Banking Ombudsman taking a defence that car loan is different from personal loan taken through credit card. You may succeed.
