my marrige have got 1 yr this month.other party alleged me as impotent in society.I said to all of them that put a petition of divorce on the grounds of impotency in d court of law n i wl defend it. But other party is demanding 30 lakh and mutual consent divorce and threatening to harm my each member of family if we wont satisfy their demands. But i am firm to go by legal way. When we complained to police (3 times n also to sp office)that they r threatening us, police today said that we sent crpc107 to tehsil office. ?-police had done their job or not? whats d role of tehsil in this? second thing- my advocate had filed 156(or something like that) crpc in court?whats d use of that? and what are d consequences of both sections??? plz reply

A. Your advocate is correct. 107 cannot be invoked. Challenge it in higher court.

sister and brother both of their parents are dead after their mothers death a Room in Mumbais chawl aquired by brother and he became the owner on papers he's got married after 3 years of marriage brother also expired now the question is who will be the owner of that room? both his sister and wife or only his wife? or only his sister? at present sisters age is 26 and brother died at 28

I have a married sister. She has a son, and 2 daughters. Her husband, brother in law and sister in law got some acres of land from their father after his death. In the recent years, they have sold some of the land secretly. Now also, her husband sent her to my place for summer vacations and tried to sell some more land. Is there any way in law, through which, My sister can challenge this land deal and force him not to sell the land?

I have built a 3 floor house consisting of ground floor, first floor, and second floor in a 20 x 30 site. The built area in second floor is 20 x 20. That consists of hall and a kitchen. Now I want to construct remaining 10 x 20 feet of two rooms. But the tenant is denying that he want six or seven months to vacate. The tenant is working in some businessman. Who is very rich in money and property. The businessman has made an agreement to pay the rent, and paying rent in his office name. He is threatening me that he will not leave the house saying that the tenant who is his employee is a backward tribe person. Whenever we interested to vacate that time only is possible to vacating the house. He is threatening me putting case on troubling the backward caste person. What is the solution.

A. 1. Issue legal notice to terminate the agreement.

2. Once the agreement terminated, it is illegal for him to stay in the property.

3. If he still stay in the property then you may file police complaint against him for illegal stay.

4. You may get back to me for further consultation.

I was caught smoking on road by polive and they filed a FIR under section 116(smoking in public place) and 117(fine upto 1200 for act under 116) . I had to pay this fine in LOKADALAT. Will this affect my selection in central government job? Do i have to mention this when they ask about criminal cases in the form?

A. No. You keep it secret. It is not an offense under IPC

hello... there is property(house) which is under the name of my mother elder sister(she is unmarried/divorced) and we are living with her from past 10 yrs...initially before building the house there was an agreement between my mom and my mom's elder sister saying that house will belong to my mom after her death and by this agreement we built the house by our own expenses and we are taking care of her but house registration was under her name as she was elder in home... now after so many years she is asking us to leave the home as house is on her name . we have some agreement papers and house registration paper with us as proof and now she is asking us to return those papers so that she can change the agreement but we are not giving those papers to her as its only proof left with us.... also she is blackmailing us that she will give complaint to police station if wont return the papers....so please let us know is it possible for her to give police complaint for papers...if yes then what we are suppose to do....

A. File suit for permanent injunction

hello sir i have my parental property 200 sq yard which is ocupied by me and 30 sq yard by a tenant from last 30 years the tenant done a forge sale deed before 15 years ago now i registered a RD with my name of whole 200 sq yard when i want to sale the property then i know that a forge sale deed also present in registrar office and my tenant is vaccant my place with take some money and release their all tenancy right know what is legal opinion for my side how i register whole 200 sq yard sale deed against buyer and buyer also want some bank loan on that property plz suggest what is now possible step for me

A. Just convince the registering authorities

Hello sir/madam As we are in financial difficulty , one of other friend has come forward to assist us financially, but they want our property ( house) registered in their name , but has assured us that as soon as we are able to repay , the property will be registered back in our name. Reg cost will be borne by both the parties both the time. My question is ,can we put a rider in the sale deed saying that , this reg is mainly for security for loan purpose , that they cannot sell the said property till the stipulated time ( time by which we should repay the amount)after the expiry of the said time , they can do as they pls with this property. Thank you Hoping for an early reply

A. Yes, it is called Conditional Sale Deed

Dear sir, My neighbour is building his house just near my boundary wall leaving no margin on his side. On ground floor, he did not open any window on our side. But on first floor and second floor, he opened a window on our side leaving no margin. We asked him to close the window as he has left no margin, but he refused to do so. we tell the problem to several peoples and when they talk to him, he said that no one can do anything against me, i will do what i want, he is very known journalist of our city and his wife works in police commissioner office. and we are just belong to middle class family. his constructional material is also fall on the land which is open in our house due to that the open land is full of cement and concrete, and he is putting ???????? in our open ground since last months, he started plaster in our side than stopped when we requested him to close window, and start working inside the house. also he is building 3-4 floor building on 20 feet road. does there is any law regarding to building height to road size. What legal actions can we take against him? Is it possible to close the window by law?

A. Say no and lodge complaint with licensing authority and approach civil. It is infringement of your privacy.
