just want to know if I can move Armed Forces Tribunal after my case is dismissed in SLP and Review in Supreme Court. The armed forces tribunal was formed after my writ petition was dismissed in the high court. i approached a military advocate and he took fees and signatures and filed SLP in supreme court instead of filing appeal in AFT. I have not availed writ appeal after dismissal of writ petition in high court due to my advocate wrong advise. Please advise.

InKumari Madhuri Patil v. Additional Commissioner, Tribal Development madyapradesh high court given fifteen directions were given for issue of community certificates which was uphold by Dayaram vs Sudhir Batham & Ors on 11 October, 2011. In that case supreme court said that "In Kumari Madhuri Patit's case, as many as fifteen directions were given, which, in our opinion, are all legislative in nature. In our opinion, if a Court feels that some law should be made, then it can only make a recommendation to that effect to the legislature but it cannot itself legislate. It is upto the legislature to accept the recommendation or not " In telangana act no 16/1993 is there for issue of community certificates .but the rules in act completely different from kumari madhuri patil case rules so can i file public interest litigation (PIL)in telangana High court to Quash the act.

A. Dear Sir/Mam, In relation to the query asked by you, the Hon'ble Supreme Court had opined about the judgment and gave it's view. The view of the Hon'ble Apex Court is, "A legislature has only the power and authority to legislate. Courts are there to interpret the legislature and not make the law. The Telengana Act no 16/1993 which according to you has all its rules completely different from the said judgment, and you want to file PIL for quashing of the Act. You can file PIL but not in reference with the said judgment because the siad judgment has not been upheld by the Hon'ble Apex Court. You may take a consultation for further legal advice.
