InKumari Madhuri Patil v. Additional Commissioner, Tribal Development madyapradesh high court given fifteen directions were given for issue of community certificates which was uphold by Dayaram vs Sudhir Batham & Ors on 11 October, 2011. In that case supreme court said that "In Kumari Madhuri Patit's case, as many as fifteen directions were given, which, in our opinion, are all legislative in nature. In our opinion, if a Court feels that some law should be made, then it can only make a recommendation to that effect to the legislature but it cannot itself legislate. It is upto the legislature to accept the recommendation or not " In telangana act no 16/1993 is there for issue of community certificates .but the rules in act completely different from kumari madhuri patil case rules so can i file public interest litigation (PIL)in telangana High court to Quash the act.

A. dear client in your matter Before filing a PIL you have to think twice because there is high cost on the petitioner.

We r 3 brothers including me. I m the eldest. Born & brought up in an ancestral house at BDD (Bombay Development Directorate) Chawls in Worli,Mumbai. Presently, myself & youngest brother staying seperately. 2nd brother staying with mom,his son, daughter & daughter in law. With mutual understanding & monetary consideration a verbal deal of equal share was finalized. Now he backed out from his commitment to pay us. Got to know from PWD (Public Works Department) office that with mom's consent he transferred the house in his name. My query. As per ancestral law,can he transfer the house by mom's consent as it's an ancestral house from father's generation. As understood that in ancestral law Mom is a custodian for the legal heirs.May be by bribing the authorities, illegal act have been done. Request advise for further course of action, cost incurred & duration pls.

A. dear client in your case Yes you can claim share.

Dear Sir, We are victim of Indian law system whereas the law allows police department to call the accuse at police station to record their statement against a complaint. We based in Jaipur and running a overseas education consultancy firm since past 15 years, our 1 candidate has filled a complaint against us in Haryana, police asked us to come and we went there with all clarification and police submitted FR in our favor. After sometime, applicant went to court and lodged case under 156(3) without intimating anything about previous proceedings and again court directed 1 police station to call us and we again went there. Truth is truth and we have all the evidences so again enquiry officer didnt found our fault and gave the FR in our favor, now the applicant went to the CM window and managed to instruct the SP to do not give final signature on the FR so that it cant be submitted to the court and opened it for re-investigation. Now, another police station is calling us to come for the statement! We are literally exhausted and not finding any way out from this system. We are unable to understand what stand should we take to get hold on this situation as applicant is using our reputation as tool and want to extract money from us. Please assist. Thanks, Pinkz

A. dear client i recommanded you to get proper legal advice from any experienced lawyer.

Respected Sir / Madam, I and my wife are senior citizens and our only son who is settled in UK does not look after us. We had appealed to concerned SDO as per 'Maintenance of parents............act-2007' and the SDO had given an order on 13.11.17 asking our son to deposit Rs.10000/- per month in my bank account. But my son did not respect the SDO's order and I have not received any money from him. I followed up with the SDO office and 5 days back the concerned staff of the office said that the least they can do is to send the order once again to my son and it is not possible for them to submit a police complain as my son stays in UK. Request you to guide me as to how I should proceed further to get my money as per Government's order. In the Maintenance act of 2007 there is also a mention that this rule applies irrespective of whether the son stays in India or abroad. Regards, D.Chatterjee

A. dear client You need to file an application before the Tribunal for execution of the Order and since the time limit of 3 months has passed by the application needs to be filed along with a Delay Condonation prayer.
