A. Amongst other things, in order to obtain the certificate, you need -
1. Either of your parents must work as a B or C category official, however in your case you can apply if your source of income is not sufficient (salary must be under 8 lakhs);
2. If you're a son and your age is 18+, you can apply for yourself showing your source of income, applying with a notarial affidavit and stamp paper worth Rs. 20;

A. Both giving and taking of bribe is illegal and crime. If your brother has given bribe to get a job then there is no way you can go and knock the door of court and ask to get it back as you can not plead as a right for a wrongful act done by you.
