My father as been adopted by one of our family member where the adopted person was married but he doesn't have children's so he adopted my father with in family as when he was 3yrs baby by without any legally papered , as family member was present in that procedure , the person who adopted is wife died and he married another lady and she had a 3 children's as further goes on my father was married after few months the adopted person's second wife made the property to her name by without any matter disputed to my father , she made property rights as gifted where the adopted person's is been transferring all is property to second wife . So now she is torching us by get out off my house and all rights and legal r my side . We are is any rights to claim a rights of property dispute to us wr in my father's basic details the father name is given as adopted person name adar card , voter card all details adopted person name as given that he is a father .. Pls say does we have any way to claim a rights

A. Dear Sir, Adoption in India is governed by Adoption and Maintenance Act. As per Law, you can only adopt a child who has not attained the age of 14 years as on the date of adoption.You may care for a child but in that case it will be a foster child and not adopted child.

Now I'm 24 and my uncle adopted me at the age of 10 and I'm having all the legal proff regarding this. They accept me as their own son over 4 daughters and after that they never treated me as the part of their family, just they showcase other that I'm their son and they never take the responsibility of my studies or anything and I'm force to live with my birth parents. Now I'm going to get married and I want to live with the adopted parents as they have no one to take care off. But the sisters are saying that the don't want me to live there and the reason behind is, they want the property of my adopted family. It is mentioned in the legal paper that none if the daughter have any right in the property and I'm the only owner of their property. So please advice me what to do in this situation

A. Dear Sir, Adoption is governed in India by the "Adoption and Maintenance Act." As per the said act the adopted child cannot go back to his biological parents and neither can the adopted parents refuse to treat the adopted child as their own child. The adopted child is as good as Own child. The provision of LAW does not devolve or change according to the wish of certain person(s). Now, for your second query, if the property in question is a self accquired property of your adopted father, then he can choose his legal heirs in contaxt of that property but if the property is an inherited property then the same will be equally divided amongst all the Legal Heirs irrespective of the fact that whether or not a WILL is executed in that behalf. You are reqested to consult for any further advice in this regard.

I am 49-year-old IT Management expert based out of Hyderabad. For the last 1.5 years, I have been helping a family from Berhampur, husband-wife-4-year-old son, financially to clear their debts, get a job, get house/plot, settle down in life and sponsoring the kids' education. This is as a part of the philanthropic efforts I have been doing for many years now. She is 29 years old. Now the situation is the husband, who has no job and 10th class pass, the wife is a graduate, is creating a situation at their home threatening to divorce her on basis of my help which he is fully aware and enjoyed the fruits. I want to know if I can adopt her as my daughter or any other legal declaration which will tell that I will be the guardian of her so that he character is not dragged on or sullied in front of the family circles and others. Hello lawyer, My wife gave a birth to a baby boy in my residence as in emergency no any time to carry in my nearest Hospitals dated : 24th, November, 17, So, I call my nearest Homoepathic Doctor to advise and as per proved for my child adoption in my residence. So, the doctor will write a certification on his letterhead for application for new birth certificate. After submitting the documents to the municipal office they send a confirmation letter to doctor for home delivery genuineness also mention that please send the log book copy and information to doctor that if found false proved legal action may be taken under RBD Act, 1969 to doctor ?? After letter received from municipal office doctor become dare and in tension to answer the letter What can I do?

Dear Sir, The provisions for getting penalized and institution of legal proceedings against someone is solely because of the reason to curtail the growing incidences of wrong statements and averments given by practicing professionals either in lieu by taking money or not. SInce, in your case, the doctor had vsited your home and everything is true and fair then neither you and your doctor need to panic for this. You can be rest assured that Law will not enalize you or anyone else who is True and has not done anything which is either prohibited by Law or Bad-in law.

Sir, my grand father has one brother and he is an elder to him. my big grand father have no children he toke my father as his son from my father childhood but he is not registered it but at the time of entering in ration cards ,voter ids and aadhaar enterd as father .my big grand father is died.how to we get the adoption proof from government of andhra pradesh

A. If the name of your grandfather is in the place of fathers name for your father then there is no other requirement for any adoption proof as because documents like PAN, ADHAAR, RATION CARD etc play a big role in confirming the details mentioned therein.
