I am currently not able to pay even minimum amount due for my credit cards and as result recovery people are visiting my home and forcing my wife to call me from her phone and make them to speak to me through. First they talk to me and demand money very arrogantly but when i deny for the payment then they declare that they will come at my residence and be there till they recover dues . Now in this scenario what can be done ? Is this style of recovery allowed ? What legally they and i can do ?

A. Dear Sir, This type of treatment is not precribed under LAW for recovery of amount. You should lodge a police complaint against them for harassement and threat to life. In addition you should also write your concern to RBI for adopting unlawful ways to get money.

Hi, I was in urgent need of money so i approached a private finance institution. Their representative got signed the loan application from me and collected all documents along with cheques as security but later on they rejected the loan. Since they rejected the loan. I asked the representative to return my application and cheques. But he is been avoiding me. I am worried that my cheques may be misused against me. What options are available to me.?

I have applied for personal loan they took 2600rs as processing fees. Then ask another 7000rs I denied I ask for refund now they are ignore and not answering what should I do legally?

A. Dear Sir, Please spoecify from whom did the transaction took place. Had they told you in writing that th cost of processing fees would be that much amount and did you agree on that. Did they communicate with you in writing. Please share complete details for an advice.

I brought a flate under sarfeasi. The association in the flate S demanding for the bending dues against the previous owner. And they treaten to cut all services including water and EB. Is that so that we have to pay the pending dues of previous owner by us. Is thr any legal binding to clear the dues?

Hi Sir, in some monetary transaction with my friend I have given him a loan of rupees 75K of rupees through check which was unfortunately got bounced...by knowing this I have paid him the money through net banking in two instalments and when I ask him to return the check he didn't give, instead he black mailed me that he will go and book a case...inspite of requesting many times he didn't return me the check and he has again represented the same check in the bank for clearing after 45 days which I was already stopped... could you pls let me know how can I proceed in this situation, will I get any penaltites from him for this action

A. Dear Sir/ Mam, Your case is a bit different from the General. You have stated that you had given him a loan through cheque which got bounced. Then again, you had transferred him the amount in two instalments. He did not return the cheque to you inspite of getting HELP from you and he is threatening you to file a case against you ( the helper ). Please reply to the queries from my side: 1. What documentary evidence do you possess to prove that you had given the amount as loan to your friend? 2. Are there any evidences available which state that you have asked him to not to deposit the cheque but yet again he did and he threatened you? 3. What was the reason for the return / dishonour of the cheque for the first time? Baiscally, what you should do is to send him a Legal Notice straight away demanding the HELP offered from your side and also you have the right to sue him. You may please consult for a further advice in this regard.

I am not able to pay credit card amount due to my unemployment and there is loan going in credit card. I paid minimum payment due monthly but it is not deduction in that credit card..... I always paid more than the amount but till I have to pay 90000/- rupees in card..... So kindly request you to advice anybody to closure of my card .....

What is meant by this statement? Did you pay more than the credit card bill and the same did not reflect in your payments made. You have also mentioned for taking a loan from your credit card. Did not take loan.. Received message stating that summons have issued by court to appear for issuing a cheque for dishonour of payment.... I have not issued a cheque or taken loan for the number sent in message or been a guarantor... No court name, case number or date is given, I called the number it is stating it is invalid number Please advise what to do Thanks.

A. Dear Sir, As per the post, you have mentioned that you have not taken any loan but still then you have received a message. It might happen that someone else gave your number intentionally or also might happen that the number taken down had some numerical mis-managed due to which the SMS was received by you. You may take a chance by ignoring that message or if want to safeguard yourself from future trouble, then you may take a consultation.

Sir i need one help. Sir ek unsuccessful bank robbery mere samne hua. Mai gawahi mai sign kia. 1 saal baad police wale mujhe notice lene k lie call krte hai court mai attend krne ke lie. Mai attend ni kr pa rha . Mujh pr kya action lia ja skta hai.

A. Dear Sir, You are not subjected to any action because you have not stated anything false before the court which has been proved. You can just be present there on next day and seek for grant for absenteeism for previous day.

I use an Axis Bank credit card. The issue is that my bank has added a transaction of INR 28,000 from the Date "February 2017" to my statement for the month of March 2018. On calling the customer care I was told that it was not added to my statement for 13 moths because of some technical issues in their systems, and they have added the amount to my statement now after 13 months of the transaction of which I have no recollect. Please advise .

A. Dear Sir, Request you to please take the complete history of the transaction with bit to bit details. 1. How have they come to the exact amount of INR 28000.00/-? 2. Have they added any interest for the period of non payment? 3. Have they shown the details as to why the same could not be added and that they have made the payment against the same? 1.Repayment of Ed.Loan is in EMI, thus we pay interest for capital paid back also. Willing to pay interest for outstanding amount, but not in EMI.Can I enforce pay back in terms of interest on outstanding amount and all extra payment to be debited to capital, like any ordinary loan. EMI is employed by loan sharks and Banks doing it is I feel illegal. Pl. advise.

A. From where have you taken the said loan in question. In general terms since ED. Loan is for a long period and the payment starts after the child stars earning. The guardian is a co-borrower. Please share across the agreement for a professional advice.
