I have deposits in a bank and opened overdraft account and do transactions in it. Recently I received a message from the bank asking me to submit AADHAAR failing which they will freeze my account. After that I sent a third pary for payment by issuing a cheque on his name. The bank denied payment with the reason that I have not submitted AADHAAR. Please clarify that is the submission of AADHAAR is mandatory even in the light of Honble Supreme court rulings? what I should do at this stage?

I have borrowed education loan. i have repaid 3/4 of the amount. I have 1/4 remaining. But they have mentioned a heavy amount as interest. I am not in a position to repay interest.bank has sent me a notice. What should i do now legally.Please suggest.

A. Hello there, As you have already paid 3/4th part of your education loan, which shows that your intention is not malafied. So you don't have to worry about it. File a reply to that notice through a Lawyer.

I bought education loan in 2008 as 118000 I didn't pay small amount to bank till now because of lack of salary and job and also kidney stone problem my health and also poor farmer family. Indian overseas Bank now send notice to me pay a NPA amount outstanding 271200 past ten there was no notice or call from bank also .we thought that bank loan and interest was discounted by government and bank..what can i do. Now bank was told come for lokadalat or you should pay 30000 now and monthly 3000 .bank ask for me Aadhar card and pan card for lokadalat process's.shall I produce Xerox copy of those .there was any problem occur while Aadhar and pan card details given to bank in future.please any body explain me and clear my all queries?

A. While taking the loan surety & collateral asset & property is pledged to the Bank .The bank can enforce the education loan through the competent agency.Better to consult a Lawyer from panel of Vidhikarya to guide & help you quickly on all aspects of repayment.

I have taken a housing loan from IDBI Bank. The loan was taken over by other PSU Bank (UBI). But even after three months of takeover the loan documents are not released by IDBI to UBI. Now, I have been informed by the IDBI that all the original documents are lost in the fire occurred at the SHCIL and now the bank is in the process of getting certified true copies from the registrar. I have following queries in this matter, 1) Do I accept these certified true copies or insist for recreation of original documents? 2)Can I sell the home in future on the basis of certified true copies? 3) Any bank will accept this property as collateral security?

Hi, I have taken a PL from a NBFC couple of years back. The EMI for the PL are getting paid and no due in EMI are pending ao far. Although due to some manual transaction for the EMI the NBFC have charged me with additional penalty. Although there is no EMI is pending for the PL so far. In these regards of the penalty amount the NBFC collection team is unnecessarily harassing me to pay the penalty amount on immediate basis although there are still few years EMI are yet to be paid in future. I sought to know is the penalty amount to be paid up has there been any rules to pay on the penalty dues entire amount at once. Also what is the term the penalty amount on the past EMI tobe paid in due times. Regards

A. What is the terms & conditions of PL and what is the EMI amount.Better to take up the issue with a banking & finance specialist lawyer to settle the issue quickly.

I am currently not able to pay even minimum amount due for my credit cards and as result recovery people are visiting my home and forcing my wife to call me from her phone and make them to speak to me through. First they talk to me and demand money very arrogantly but when i deny for the payment then they declare that they will come at my residence and be there till they recover dues . Now in this scenario what can be done ? Is this style of recovery allowed ? What legally they and i can do ?

A. Dear Sir, This type of treatment is not precribed under LAW for recovery of amount. You should lodge a police complaint against them for harassement and threat to life. In addition you should also write your concern to RBI for adopting unlawful ways to get money.

Hi, I was in urgent need of money so i approached a private finance institution. Their representative got signed the loan application from me and collected all documents along with cheques as security but later on they rejected the loan. Since they rejected the loan. I asked the representative to return my application and cheques. But he is been avoiding me. I am worried that my cheques may be misused against me. What options are available to me.?

A. Dear Sir, You may approach the police, you may approach the registrating office of such financial institution or get issue a legal notice and file a private complaint to return the cheques.

I brought a flate under sarfeasi. The association in the flate S demanding for the bending dues against the previous owner. And they treaten to cut all services including water and EB. Is that so that we have to pay the pending dues of previous owner by us. Is thr any legal binding to clear the dues?
