My grand mother and father has been expired. They did not mention their nomeeni in saving account. For withdrawal we have finished all the formalities, except heirship certificate( kursinama) the problem is who will sign on the heirship certificate. We living in tehsil Nagar Palika chairman or tehsildar.

A. https://wikiprocedure.com/index.php/Maharashtra_-_Obtain_a_Legal_Heir_Certificate_(Succession_Certificate) Maharashtra - Obtain a Legal Heir Certificate (Succession Certificate) You can obtain a Legal Heir / Succession Certificate through your Taluk / Thasildhar or through the District Civil Court of your area. The best approach would be to get in touch with the Taluk / Thasildhar office of your area they should be able to provide you with the certificate or in some cases you might be asked to contact a lawyer in District Civil Court to get it done. Based on the report of the Village Administrative Officer and Revenue Inspector and after due enquiry, this certificate is issued by the Concerned Authority mentioning the names of all legal heirs of the deceased.

I have a credit card in Dubai which I dint settle and came to India due to personal emergency. I cannot pay back them, not in position to repay or make settlement. I started receiving email from there Indian counterpart or sister companies for settlement or to face legal consequences. Will they have legal rights on me on any basis for credit cards which I have taken in Dubai. Please advise.

Respected sir/Madam My self and My Father are co-borrower of the loan for construction of house, from past 5 years i am paying the loan EMI , when i asked him to shere the EMI he replied like you are not taking care of me, so you alone pay the EMI, my question is that can i legally ask him to pay next five years EMI and there onwors share the EMI equally every month . A. Dear Sir, Nothing happen. He have full right over entire property if he does not chose to pay. The similar case is as follows. ========================================================================================================= Joint Ownership of Property Differentiating co-owners and co-borrowers Joint-owners or co-owners are those people who have a share in the said property. More than one person can be the owner of a property. Joint property owners most of the times are spouse or it could be parents, children or siblings. A property can also be jointly owned with anyone- it could be friends, colleagues, distant relatives etc. While there are no restrictions in owning a property with anyone, joint home loans come in with certain restrictions. Banks do not sanction joint home loans for relations other than husband-wife, parents and children and in certain cases for brothers, provided they have joint ownership. Co-ownership of property not is generally mandatory for considering the income of applicants for a loan. All co-borrowers are equally responsible for repayment of loan taken from the bank. Who is liable to repay the loan? The liability to repay the loan obtained lies equally with all of the applicants. For example, let us suppose that a working couple has applied for a joint home loan and after few years, the wife stopped working and the husband continues paying the loan EMIs by himself. Now if he had temporarily stops working due and the EMIs could not be paid, the bank serves notice for nonpayment against both husband and wife, as they are equally responsible for loan repayment. What happens if you become a loan defaulter? Once you become a loan defaulter, the bank will start the process of taking over your property. They can arrange an auction to sell your house/flat and recover their due amount. If you want to take any action, you need to take before this auction. Apart from this, your credit score will also be hit hard and you might not be eligible for loans in the future. This can be the worst thing to happen to you. What are the options in this situation? The best option for you would be to negotiate with the lender upon this. Banks will be ready to talk you over this issue rather than going through the tiresome process of taking over your asset. You can reach out to them with the past documents of EMI payments for this loan or the previous loans that you have cleared. Let us see what all options you have in hand: 1) Ask for a grace period - You can seek a grace period from the bank in order to continue with the EMI payments. You can clearly explain to them the reasons for not being able to pay EMIs such as loss of job or dip in sales of business, etc. Bank may be willing to give you the grace period for resuming EMI payments with some penalty. 2) Loan refinancing - There could be a case where the interest rates have gone up and hence you may not afford the increased EMI. You can talk to the bank to restructure or refinance your home loan. They can increase the tenure of the loan as a result of which your EMI would go down. Though this will result in you paying more, it will be better than losing possession of the property. 3) Counseling centers - There are counseling centers to help you with this issue. They would provide you the appropriate options based on your situation. They will also give you fair knowledge on the things to be followed so that you do not fall into a debt trap. Dena Bank has a credit counseling center which does exactly this. 4) Liquidating your investments - This will be the final step that you can resort to, if the above options do not work out for you. You can liquidate your existing investments such as deposits or mutual funds to pay the EMIs. You can also use this amount to make part payment for the loan which will reduce the EMI going forward.

I have a friend staying in US I have transferred the money 2 lakh to his friend account who is staying in andra.Now my friend staying in US not responding to me how do I get the money back Problem is I dont have any supporting except online transfer since he was family friend I transferred Please guide

A. 1. Online transfer receipt is more than enough to file a case. 2. Issue legal notice through embassy. 3. If money is not paid even after legal notice issued then file police complaint. On the complaint include the transaction details. 4. IO can block the account and release the money to you ( with the orders from the court ). 5. You may approach me for further details.

I made a payment of 2000rs through my bank account to a site named Ondoor for some goods through a Tansaction gateway(CCAMOTO), the money got deducted from my account but the site ondoor(based in bhopal) did not receive the payment and i didnt get any conformation message about the transaction. When I contacted my bank (SBI) they told me that the transaction has taken place successfully and the merchant also confirmed the transaction as successfull but the site ondoor is saying that no money was received by them how can they say so if it was confirmed by both the bank and the gateway(CCAMOTO) please advise me what should i do and which agency is the culprit in this matter.

I have deposits in a bank and opened overdraft account and do transactions in it. Recently I received a message from the bank asking me to submit AADHAAR failing which they will freeze my account. After that I sent a third pary for payment by issuing a cheque on his name. The bank denied payment with the reason that I have not submitted AADHAAR. Please clarify that is the submission of AADHAAR is mandatory even in the light of Honble Supreme court rulings? what I should do at this stage?

I have borrowed education loan. i have repaid 3/4 of the amount. I have 1/4 remaining. But they have mentioned a heavy amount as interest. I am not in a position to repay interest.bank has sent me a notice. What should i do now legally.Please suggest.

A. Hello there, As you have already paid 3/4th part of your education loan, which shows that your intention is not malafied. So you don't have to worry about it. File a reply to that notice through a Lawyer.

I bought education loan in 2008 as 118000 I didn't pay small amount to bank till now because of lack of salary and job and also kidney stone problem my health and also poor farmer family. Indian overseas Bank now send notice to me pay a NPA amount outstanding 271200 past ten there was no notice or call from bank also .we thought that bank loan and interest was discounted by government and bank..what can i do. Now bank was told come for lokadalat or you should pay 30000 now and monthly 3000 .bank ask for me Aadhar card and pan card for lokadalat process's.shall I produce Xerox copy of those .there was any problem occur while Aadhar and pan card details given to bank in future.please any body explain me and clear my all queries?

A. While taking the loan surety & collateral asset & property is pledged to the Bank .The bank can enforce the education loan through the competent agency.Better to consult a Lawyer from panel of Vidhikarya to guide & help you quickly on all aspects of repayment.
