I am not able to pay credit card amount due to my unemployment and there is loan going in credit card. I paid minimum payment due monthly but it is not deduction in that credit card..... I always paid more than the amount but till I have to pay 90000/- rupees in card..... So kindly request you to advice anybody to closure of my card .....

A. Dear Sir, If you have no amount then there is no issue. Never lift phone of bank. SC protect as follows. ICCI Bank Limited vs. Prakash Kaur case, The Supreme Court in a landmark judgement reiterated its earlier stand that banks cannot deploy musclemen for recovery of loans from defaulters thus forcing them to end their lives. "We deem it appropriate to remind the banks and other financial institutions that we live in a civilised country and are governed by the rule of law," a bench comprising Justices Tarun Chatterjee and Dalveer Bhandari said. The court while dismissing the ICICI Bank's plea refused to delete the Delhi High Court's remarks that held the bank and its musclemen responsible for abetting a youth to commit suicide by humiliating him and taking away his motorcycle financed by the largest private sector bank. It also asked the ICICI Bank to to pay Rs 25,000 as cost of this litigation to the respondents within three weeks and directed the Delhi Police to conclude the investigation against the bank expeditiously within three months, keeping in view the gravity of the allegations. The court also directed the concerned Deputy Commissioner of Police to submit the investigation report in the Delhi High Court. According to the court, complaints received by Reserve Bank regarding violation of the above guidelines and adoption of abusive practices followed by banks recovery agents would be viewed seriously. Reiterating the RBI Guidelines on Engagement of Recovery Agents, the court said, "The Reserve Bank may consider imposing a ban on a bank from engaging recovery agents in a particular area, either jurisdictional or functional, for a limited period. In case of persistent breach of above guidelines, Reserve Bank may consider extending the period of ban or the area of ban." "RBI had expressed its concern about the number of litigations filed against the banks in the recent past for engaging recovery agents who have purportedly violated the law," Justice Bhandari, writing the verdict for the bench, stated. RBI in a letter accompanying its April 24, 2008 Guidelines had stated that it might consider imposing a ban on a bank from engaging recovery agents in a particular area, either jurisdictional or functional, for a limited period. ICICI Bank had moved the apex court seeking deletion of some paragraphs in the High Court order which had said that "...the proximate cause of death of the deceased that led him to commit suicide was on account of humiliation caused by the Bank people from where loan was taken by him." "The modus-operandi employed by the banks like ICICI for realisation of their loan amount and for recovering the possession of the vehicle against which loans are given is extra legal and by no stretch of imagination they can be permitted to employ musclemen and goons for recovery of their dues even from a defaulting party," the High Court had observed. The High Court order had come on a petition filed by Shanti Devi Sharma, the deceased's mother, seeking a probe against the ICICI bank and its staff for the unlawful action, which led to the suicide of her 34-year old son Himanshu Dev Sharma. Sharma had committed suicide in October 2005 by hanging himself at his house after he was allegedly intimidated and humiliated in front of his neighbours and family by recovery agents employed by the bank for recovering the loan amount taken for his motorcycle. The ICICI Bank had contended that it was within its rights to recover loans and had followed the required procedure for recovering dues.

Did not take loan.. Received message stating that summons have issued by court to appear for issuing a cheque for dishonour of payment.... I have not issued a cheque or taken loan for the number sent in message or been a guarantor... No court name, case number or date is given, I called the number it is stating it is invalid number Please advise what to do Thanks.

Sir i need one help. Sir ek unsuccessful bank robbery mere samne hua. Mai gawahi mai sign kia. 1 saal baad police wale mujhe notice lene k lie call krte hai court mai attend krne ke lie. Mai attend ni kr pa rha . Mujh pr kya action lia ja skta hai.

I use an Axis Bank credit card. The issue is that my bank has added a transaction of INR 28,000 from the Date "February 2017" to my statement for the month of March 2018. On calling the customer care I was told that it was not added to my statement for 13 moths because of some technical issues in their systems, and they have added the amount to my statement now after 13 months of the transaction of which I have no recollect. Please advise .

A. dear client it is better to approach the banks ombudsman immediately. before that lodge details to the bank manager in writing.

1.Repayment of Ed.Loan is in EMI, thus we pay interest for capital paid back also. Willing to pay interest for outstanding amount, but not in EMI.Can I enforce pay back in terms of interest on outstanding amount and all extra payment to be debited to capital, like any ordinary loan. EMI is employed by loan sharks and Banks doing it is I feel illegal. Pl. advise.

A. dear client in your case Do you have a signed copy of the agreement. If yes, then please share. the transfer of money can be proved before the court but the reason for transfer has to be proved also. Please share the available evidences to ascertain the viability of the case and to get a professional advice for the same.

Hello All, In the year 2015, I had taken a personal loan of Rs 300000/- from bajaj Finserv in Bangalore. Till last month the collection agents come to my place and collect the cash. The due date is on 25th of every month. This month I had lost my job and I was unable to make the payment. I had conveyed the same to the agent who had called. But he was very abusive and harrassed. Hence I had escalated the issue to the Bajaj Finserv people regarding the same and had requested time to make the payment to which they had agreed. However the agent has visited my place when I was not present instead my mother was there all alone. They had literally shouted at her and harrassed her. When my mother had called me and told I spoke to the agent and the agent's manager stating that I had already spoken to the Bajaj Finserv regarding this and got a confirmation. But the agent manager was vetmry abusive and demanded that he need it right now and he also mentioned that he does not care if we talk to bajaj team. I had told them that I have taken a loan from bajaj and liable only to them. But he said that bajaj pays my salary and it is my money. He was also abusive to my mother. Need legal advice and want to know if I can log a legal complaint against the agent and his manager for harrassment.

Dear Sir, I have taken Loan from Cashe ( Mobile Based Loan lender) of Rs.30000/- by 12/05/2017. While disbursing the loan itself they have taken Rs.2750/- as upfront interest for a period of three months as monthly EMI 10000/- for each month. Due to some personal issues i was not paid the loan on time. Finally got approval for making payment of principal amount of Rs.30000/- on 15th November 2017 & made payment on same day. I got confirmation from the Lender for Rs.30000/- through mail . Now they are harrasing me to pay another Rs.14500/- as interest & sent legal notice . Kindly requesting you to do needful to take futher action on them. Is there any option to file defamation case & claim the amount & also can i file a cheating case on them for false promise . A. dear client in your case As per the RBI guideline the loan lender should be registered and get licence for lending activities.You have a option to lodge complaint ombudsmen authorities of RBI.

I bought 30000 as education loan and completed my degree in 2014 So far i have repay 6000 But stilll sbi bank says i have 50000 pending What to do. Why they are doubling the loan amount without any letter for the past three years only this year they are notifying you have to pay loan

A. dear client in your case You cannot be made a guarantor without your signing on documents in the Bank. you can apply to the bank and you tell the Bank to auction the property.
