Dear Sir, Good afternoon... I'm very much in need of a legal advice regarding my child's custody after separation and divorce... some important referral I would share with you... 1. We agreed to a mutual divorce as my wife is unhappy with us and me too. This is because of some idiological differences between us... 2. Before marriage, we both agreed to certain points one of which is that primarily she will be a home maker...on such she left her job she was holding before marriage... 3. But few months after the marriage, she started screaming about the issue of getting a job... 4. The issue is that she ignores almost all the domestic responsibilities which includes the child too... 5. Since last few months, we stays apart and she stays at a place where she got a job in a school. 6. We are three in our family me, my father and my child, whereas my mother has expired in the recent past. Due to such complicacies we have decided to stay apart...and go mutual divorce... 7. Now she suddenly demanding for the custody of the child whereas she was with me since our separation. 8. Importantly, my child is with me and studying in class III and is attending her school regularly. Now, If her mother take her custody, she might loose a year... which might be a disgusting matter for my child's point of view... Please suggest... With Regards Joydeep Gupta

Dear Sir/Madam, A very good morning to you...I need some legal advice in connection to my divorce petition to be filed soon... 1. I have a girl child, who is in 8+ now, her mother wants her custody before the verdict and has intended for a deed of agreement to her lawyer... what I want to know from you is that whether I should agree to such deed?... this is because my child's school is going on and she needs a school transfer order as her mother is serving in a school around 100 k.m. from my place... 2. We agreed to a mutual divorce... but never talked about the girls overall development, marriage, father's role and responsibilities towards all these... 3. Importantly, if her mother is to take care of her, then where I am to my child...? 4. If her mother intends for a second marriage, then where my child's fate will lie... in the contrary, if me too then where she will be in the society??? These points are knocking me and I am looking forward for a balanced solution keeping in mind for a better future of my child where she can grow as she should... 5. Importantly, her mother has some extramarital affairs for which I am in a dilemma about my child's development...please advice what to do... The advocate she is following, couldn't provide me a better option in this regard. 6. At the same time I am very much concern about my child's overall growth...and can sign anywhere in this regard... Please guide me... Thank you. Regards Joydeep Gupta Guwahati, Assam.

Me and my wife both are wiling to take mutual divorce now after 1 year 2 months of marriage life and we have 3 months old baby girl. Now my wife does want to take child custody. Is she legally do so? If she doesn't want take custody of baby, is she bound to bear 50% of child maintenance expenses in future if child stays with me. Please note my wife is a working woman
Share this questionShare Icon

A. maintenance of the child is on the parents ad the court watch the interest of the child who can better bring up the child betterand the custodyof the child is entrusted to that parent, here the court will watch the income of the parents and decide the proportion of the expenses of the maintenance .FILE A CASE IN FAMILY COURT. for details, pl. contact some advocatethrough vidhikarya.com
