You are too the natural Guardian of your child. The visitation right of a non custodian parents is for the welfare if the child. If your ex wife is not allowing you to meet your child, she is not agreeing with the terms if the court. She can be sued.

A. Hi,
You have the option to not appear before the court in Australia if you do not want the Divorce proceedings to be binding on you. If your child is staying with you in India then it is not possible for your husband to get the custody of the child unless he files a case in India for custody.
