you can get justice within 3 months if you approach the High Court and get a direction from it to the family court and family court is supposed to dispose within 12 months. Exercise your legal rights never sleep over your rights. Please give me Rank 5 if you feel my answer helped you

To get the best remedy out of your situation you need to take legal help.
You can complain against him in the police-station . You can file a case of Domestic Violence, 498(A) AND a lot more. The competent court will determine a number of facts like the financial status of you and your husband and give a remedy accordingly. And as your child is a minor he is supposed to remain with you.
So , suggestion would be to take legal help and hence appoint an Advocate.
